AMENDMENT TO HOUSE BILL 3758

2    AMENDMENT NO. ______. Amend House Bill 3758 on page one,
3line 5 by deleting "2,"; and
 
4on page one, line 5, after "12," by inserting "14,"; and
 
5by deleting line 7, page one through line 9, page 3; and
 
6by replacing line 16, page 7 through line 19, page 8 with the
7following:
 
8    "(70 ILCS 1810/12)  (from Ch. 19, par. 163)
9    Sec. 12. (a) The governing and administrative body of the
10District shall be a board consisting of 5 9 members, to be
11known as the Illinois International Port District Board, who
12shall be appointed for a term of 3 years by the Mayor with the
13advice and consent of the city council of the city of Chicago.
14Members of the Board shall be residents of a county whose

1territory, in whole or in part, is embraced by the District and
2persons of recognized business ability. The members of the
3Board shall receive no compensation for their services, set by
4the Board at an amount not to exceed $20,000.00 annually,
5except the Chairman may receive an additional $5,000.00
6annually, if approved by the Board. All such compensation shall
7be paid directly from the Port District's operating funds. The
8members shall receive no other compensation whatever, whether
9in form of salary, per diem allowance or otherwise, for or in
10connection with his service as a member. The preceding sentence
11shall not prevent any member from receiving any non-salary
12benefit of the type received by employees of the District. Each
13member may shall be reimbursed for actual expenses incurred by
14them in the performance of their duties. Any person who is
15appointed to the office of secretary or treasurer of the Board
16may receive compensation for services as such officer, as
17determined by the Board, provided such person is not a member
18of the Board. No member of the Board or employee of the
19District shall have any private financial interest, profit or
20benefit in any contract, work or business of the District nor
21in the sale or lease of any property to or from the District.
22    (b) The terms of all members of the Illinois International
23Port District Board serving on the effective date of this
24amendatory Act of the 99th General Assembly end on the 31st day
25after the effective date of this amendatory Act of the 99th
26General Assembly. Thereafter, the seat of each member shall be

1vacant and subject to reappointment as provided in subsection
2(a) of this Section.

5    Sec. 14. Members of the Board shall hold office until their
6respective successors have been appointed and qualified. Any
7member may resign from his or her office, to take effect when
8his or her successor has been appointed and has qualified. The
9Governor and the Mayor, respectively, may remove any member of
10the Board appointed by him or her in case of incompetency,
11neglect of duty, or malfeasance in office. They shall give him
12or her a copy of the charges against him or her and an
13opportunity to be publicly heard in person or by counsel in his
14or her own defense upon not less than ten days' notice. In case
15of failure to qualify within the time required, or of
16abandonment of his or her office, or in case of death,
17conviction of a crime or removal from office, his office shall
18become vacant. Each vacancy shall be filled for the unexpired
19term by appointment in like manner, and with like regard as to
20the place of residence of the appointee, as in case of
21expiration of the term of a member of the Board.
