1 | | 1, 2016. If a passenger vehicle contains specialty equipment |
2 | | that cannot be removed and would render the vehicle unlawful |
3 | | for private use on a public roadway, the vehicle shall not be |
4 | | sold to a private person or entity, but must be given to |
5 | | another State agency or sold to another governmental body for |
6 | | whom use of the vehicle is legal. Proceeds from the sale of |
7 | | vehicles as provided in this Section shall be deposited into |
8 | | the State Surplus Property Revolving Fund. |
9 | | (b) This Section does not apply to police or emergency |
10 | | vehicles or vehicles for which a State employee's personal |
11 | | vehicle cannot be substituted without causing excessive wear |
12 | | and tear to the personal vehicle in the opinion of the |
13 | | Director. If the Director opts not to sell a vehicle pursuant |
14 | | to the exceptions provided for in this subsection (b), the |
15 | | Director shall file a report with the Clerk of the House, the |
16 | | Minority Leader of the House, the Secretary of Senate, the |
17 | | Minority Leader of the Senate, and the Governor on or before |
18 | | October 1, 2015 explaining why the exceptions herein provided |
19 | | applied to the vehicle. |
20 | | (c) For purposes of this Section: |
21 | | "General purpose passenger vehicles" means cars, |
22 | | minivans, sport utility vehicles, crossovers or other |
23 | | vehicles with not more than a 10 passenger capacity. |
24 | | "Light duty vehicles" means vans, pickups or trucks |
25 | | with 8,000 lbs or less gross vehicle weight rating.
