AMENDMENT TO HOUSE BILL 3764

2    AMENDMENT NO. ______. Amend House Bill 3764 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Department of Central Management Services
5Law of the Civil Administrative Code of Illinois is amended by
6adding Section 405-282 as follows:
 
7    (20 ILCS 405/405-282 new)
8    Sec. 405-282. Sale of State vehicles.
9    (a) Notwithstanding any other provision of law to the
10contrary, all State-owned general purpose passenger and light
11duty vehicles that were reported in the Performance Audit of
12the Department of Central Management Services' Operation of the
13State Vehicles Fleet released by the Office of the Auditor
14General in November 2011 to have been driven 7,000 miles or
15less in Fiscal Year 2010 are deemed surplus and shall be sold
16using a competitive sealed bid method of sale on or before July

11, 2016. If a passenger vehicle contains specialty equipment
2that cannot be removed and would render the vehicle unlawful
3for private use on a public roadway, the vehicle shall not be
4sold to a private person or entity, but must be given to
5another State agency or sold to another governmental body for
6whom use of the vehicle is legal. Proceeds from the sale of
7vehicles as provided in this Section shall be deposited into
8the State Surplus Property Revolving Fund.
9    (b) This Section does not apply to police or emergency
10vehicles or vehicles for which a State employee's personal
11vehicle cannot be substituted without causing excessive wear
12and tear to the personal vehicle in the opinion of the
13Director. If the Director opts not to sell a vehicle pursuant
14to the exceptions provided for in this subsection (b), the
15Director shall file a report with the Clerk of the House, the
16Minority Leader of the House, the Secretary of Senate, the
17Minority Leader of the Senate, and the Governor on or before
18October 1, 2015 explaining why the exceptions herein provided
19applied to the vehicle.
20    (c) For purposes of this Section:
21        "General purpose passenger vehicles" means cars,
22    minivans, sport utility vehicles, crossovers or other
23    vehicles with not more than a 10 passenger capacity.
24        "Light duty vehicles" means vans, pickups or trucks
25    with 8,000 lbs or less gross vehicle weight rating.

1    Section 99. Effective date. This Act takes effect upon
2becoming law.".
