AMENDMENT TO HOUSE BILL 3765

2    AMENDMENT NO. ______. Amend House Bill 3765 by replacing
3everything after the enacting clause with the following:
 
4    "Section 1. Short title. This Act may be cited as the
5Springfield High Speed Railroad Oversight Act.
 
6    Section 5. Definitions. For purposes of this Act:
7    "Department" means the Department of Transportation.
8    "Minority owned business", "business owned by a person with
9a disability", and "female owned business" shall have the
10meanings provided in Section 2 of the Business Enterprise for
11Minorities, Females, and Persons with Disabilities Act.
12    "High Speed Rail Project" means the Illinois High Speed
13Rail Program, led by the Illinois Department of Transportation
14and the Federal Railroad Administration, which is designed to
15enhance the passenger transportation network in the
16Chicago-St. Louis corridor.

1    Section 10. Diversity program; purposes. The Department,
2the City of Springfield, and Sangamon County shall establish
3and maintain a diversity program to ensure environmental
4justice, as well as local involvement and non-discrimination,
5in all contracts related to the High Speed Rail Project in the
6City of Springfield and Sangamon County. The program shall do
7each of the following:
8    (1) Guarantee equal employment opportunities for socially
9and economically disadvantaged workers, particularly in areas
10affected by the High Speed Rail Project.
11    (2) Increase participation by minorities, women, and
12persons with disabilities in employment opportunities.
13Contracts related to the High Speed Rail Project shall meet a
14goal of at least 25% minority hiring.
15    (3) Increase participation by small businesses, minority
16owned businesses, businesses owned by a person with a
17disability, and female owned businesses in contracting.
18Contracts related to the High Speed Rail Project shall meet the
19Department's existing 22.77% Disadvantaged Business Enterprise
20participation goal for competitively let construction
21projects.
22    (4) Provide new funds equal to 1/2 of 1% of the project
23budget to local job training and support programs.
24    (5) Engage the full and fair participation of all
25potentially affected communities in the transportation

1decision making process concerning the construction of the High
2Speed Rail Project.
3    (6) Ensure compliance with all State and federal hiring
4regulations, including, but not limited to, goals for hiring
5women and minorities, and prohibitions on discrimination.
6    (7) Ensure proper support and adequate resources are
7available for the appointed rail relocation ombudsman.
8    If the implementation of any of the provisions of this
9Section 10 would negatively affect the receipt of federal
10funding, then the provisions of Section 10 shall not apply.
 
11    Section 15. Springfield High Speed Railroad Oversight
12Commission. The Springfield High Speed Railroad Oversight
13Commission ("Commission") is created to monitor, review, and
14report on contracting and employment related to the planning,
15organization, and construction of the High Speed Rail Project.
16The Commission shall consist of 13 members who shall be
17appointed, within 90 days of the effective date of this Act, as
18follows:
19    (1) One member of the Senate appointed by the President of
20the Senate, who shall serve as a Co-Chairperson of the
21Commission.
22    (2) One member of the House of Representatives appointed by
23the Speaker of the House, who shall serve as a Co-Chairperson
24of the Commission.
25    (3) One member of the Senate appointed by the Minority

1Leader of the Senate.
2    (4) One member of the House appointed by the Minority
3Leader of the House of Representatives.
4    (5) One member appointed by the Speaker of the House of
5Representatives representing the community surrounding the
6Springfield High Speed Railroad project area.
7    (6) One member appointed by the Governor representing
8community organizations operating within the community
9surrounding the High Speed Rail Project area in Springfield.
10    (7) One member appointed by the President of the Senate
11representing a minority chamber of commerce.
12    (8) One member appointed by the Minority Leader of the
13Senate who is a minority or female and a licensed professional
14engineer.
15    (9) One member appointed by the Minority Leader of the
16House of Representatives representing the City of Springfield.
17    (10) One member appointed by the President of the Senate
18representing Sangamon County.
19    (11) One member appointed by the Speaker of the House of
20Representatives representing a statewide labor organization.
21    (12) One member appointed by the Governor representing the
22Illinois Department of Transportation.
23    (13) The independent ombudsman for the 10th Street Rail
24Corridor.
 
25    Section 20. Commission meetings; authority; reporting. The

1Commission shall meet quarterly. The Commission shall have the
2authority to convene City, County, and Department officials to
3ensure compliance with the above stated goals.
4    On January 1, 2016, and on the first of each quarter
5thereafter until the completion of the High Speed Rail Project,
6the Commission shall issue a written report to the Governor,
7President of the Senate, Speaker of the House of
8Representatives, Minority Leader of the Senate, Minority
9Leader of the House of Representatives, Mayor of Springfield,
10Springfield City Council, Sangamon County Board, and the
11Department describing in detail the Project's compliance with
12the requirements of Section 10 of this Act. If in any reporting
13period any portion of the Project is not in compliance with its
14respective obligations, each entity that is not in compliance
15shall, by the end of the first month of the reporting period,
16file with the Commission a written explanation setting forth
17the reason or reasons for noncompliance. The Commission shall
18then meet within one week after receiving the written
19explanations to discuss the stated reason or reasons for
20noncompliance.
 
21    Section 25. Home rule. The requirements of this Act are
22exclusive powers and functions of the State. This Act is a
23denial and limitation of home rule powers and functions under
24subsection (h) of Section 6 of Article VII of the Illinois
25Constitution.

1    Section 99. Effective date. This Act takes effect upon
2becoming law.".
