| 1 | AMENDMENT TO HOUSE BILL 4257

| 2 | AMENDMENT NO. ______. Amend House Bill 4257 by replacing | ||||||
| 3 | everything after the enacting clause with the following:
| ||||||
| 4 | "Section 1. Legislative findings and intent. The General | ||||||
| 5 | Assembly finds that individuals with developmental or mental | ||||||
| 6 | disabilities may sometimes have a difficult time | ||||||
| 7 | communicating. This can be especially true in high stress | ||||||
| 8 | situations, such as, but not limited to, interacting with | ||||||
| 9 | criminal justice professionals. It is the intent of the General | ||||||
| 10 | Assembly to provide a solution to de-escalate these situations | ||||||
| 11 | by providing a way for individuals with disabilities to help | ||||||
| 12 | inform or notify criminal justice professionals of the | ||||||
| 13 | individual's disability. | ||||||
| 14 | Section 5. The Illinois Identification Card Act is amended | ||||||
| 15 | by adding Section 4A-1 as follows: | ||||||

| 1 | (15 ILCS 335/4A-1 new) | ||||||
| 2 | Sec. 4A-1. Person with a disability wallet card. | ||||||
| 3 | (a) Upon approval of an applicant's Illinois Person with a | ||||||
| 4 | Disability Identification Card, the Secretary of State shall | ||||||
| 5 | inform the applicant of the availability of a Person with a | ||||||
| 6 | Disability Wallet Card that specifies that the cardholder has | ||||||
| 7 | been medically diagnosed with a disability, and shall provide | ||||||
| 8 | that Wallet Card upon the applicant's request. This Wallet Card | ||||||
| 9 | may only be available to applicants with a Type Two or Type | ||||||
| 10 | Five Disability as define in Section 4A of this Act. | ||||||
| 11 | (b) The Department of Human Services shall design the | ||||||
| 12 | Wallet Card in consultation with the Secretary of State, after | ||||||
| 13 | which, the Department of Human Services shall produce and | ||||||
| 14 | distribute the cards to the Secretary of State. | ||||||
| 15 | (c) The Secretary of State shall work with the Department | ||||||
| 16 | of Human Services to adopt rules in the administration of the | ||||||
| 17 | Wallet Card.".
