| 2 | | AMENDMENT NO. ______. Amend House Bill 4334 by replacing |
| 3 | | everything after the enacting clause with the following:

| 4 | | "Section 5. The Illinois Vehicle Code is amended by |
| 5 | | changing Section 3-821.2 as follows: |
| 6 | | (625 ILCS 5/3-821.2) |
| 7 | | Sec. 3-821.2. Delinquent registration renewal fee. |
| 8 | | (a) For registration renewal periods beginning on or after |
| 9 | | January 1, 2005, the Secretary of State may impose a delinquent |
| 10 | | registration renewal fee of $20 for the registration renewal of |
| 11 | | all passenger vehicles of the first division and motor vehicles |
| 12 | | of the second division weighing not more than 8,000 pounds if |
| 13 | | the application for registration renewal is received by the |
| 14 | | Secretary more than one month after the expiration of the most |
| 15 | | recent period during which the vehicle was registered. If a |
| 16 | | delinquent registration renewal fee is imposed, the Secretary |

| 1 | | shall not renew the registration of such a vehicle until the |
| 2 | | delinquent registration renewal fee has been paid, in addition |
| 3 | | to any other registration fees owed for the vehicle. Active |
| 4 | | duty military personnel stationed outside of Illinois shall not |
| 5 | | be required to pay the delinquent registration renewal fee. If |
| 6 | | a delinquent registration renewal fee is imposed, the Secretary |
| 7 | | shall adopt rules for the implementation of this Section. All |
| 8 | | fees collected under this Section shall be deposited into the |
| 9 | | General Revenue Fund.

| 10 | | (b) Notwithstanding the provisions of subsection (a), the |
| 11 | | Secretary of State shall not impose a delinquent registration |
| 12 | | renewal fee for the registration renewal of passenger vehicles |
| 13 | | of the first division and motor vehicles of the second division |
| 14 | | weighing not more than 8,000 pounds if a vehicle's registration |
| 15 | | expires during a period of time in which the Secretary is not |
| 16 | | sending registration renewal notices to owners of all of those |
| 17 | | vehicles. No local, county, municipal, or State law enforcement |
| 18 | | agency may issue a citation for an expired registration until |
| 19 | | one month after the expiration of the registration during any |
| 20 | | time period in which the Secretary is prohibited from imposing |
| 21 | | delinquent registration renewal fees under this subsection |
| 22 | | (b). If the Secretary resumes sending registration renewal |
| 23 | | notices to owners of all passenger vehicles of the first |
| 24 | | division and motor vehicles of the second division weighing not |
| 25 | | more than 8,000 pounds, then the Secretary may resume the |
| 26 | | collection of the delinquent registration renewal fee under |

| 1 | | subsection (a), and any local, county, municipal, or State law |
| 2 | | enforcement agency may resume citing any vehicle with an |
| 3 | | expired registration without waiting the one month period |
| 4 | | required by this subsection (b). The changes made by this |
| 5 | | amendatory Act of the 99th General Assembly apply only to |
| 6 | | vehicle registrations that expire on or after the effective |
| 7 | | date of this amendatory Act of the 99th General Assembly. |
