AMENDMENT TO HOUSE BILL 4334

2    AMENDMENT NO. ______. Amend House Bill 4334, AS AMENDED, by
3replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The Illinois Vehicle Code is amended by
6changing Section 3-821.2 as follows:
 
7    (625 ILCS 5/3-821.2)
8    Sec. 3-821.2. Delinquent registration renewal fee.
9    (a) For registration renewal periods beginning on or after
10January 1, 2005, the Secretary of State may impose a delinquent
11registration renewal fee of $20 for the registration renewal of
12all passenger vehicles of the first division and motor vehicles
13of the second division weighing not more than 8,000 pounds if
14the application for registration renewal is received by the
15Secretary more than one month after the expiration of the most
16recent period during which the vehicle was registered. If a

1delinquent registration renewal fee is imposed, the Secretary
2shall not renew the registration of such a vehicle until the
3delinquent registration renewal fee has been paid, in addition
4to any other registration fees owed for the vehicle. Active
5duty military personnel stationed outside of Illinois shall not
6be required to pay the delinquent registration renewal fee. If
7a delinquent registration renewal fee is imposed, the Secretary
8shall adopt rules for the implementation of this Section. All
9fees collected under this Section shall be deposited into the
10General Revenue Fund.
11    (b) Notwithstanding the provisions of subsection (a), the
12Secretary of State shall not impose a delinquent registration
13renewal fee for the registration renewal of passenger vehicles
14of the first division and motor vehicles of the second division
15weighing not more than 8,000 pounds if a vehicle's registration
16expires during a period of time in which the Secretary is not
17sending registration renewal notices to owners of all of those
18vehicles with registration expiring at the same time as the
19applicable vehicle. It shall be an affirmative defense to a
20citation for an expired registration issued by any local,
21county, municipal, or State law enforcement agency within one
22month after the expiration of vehicle registration, that the
23expiration occurred during a period of time in which the
24Secretary was not sending registration renewal notices to
25owners of all passenger vehicles of the first division and
26motor vehicles of the second division weighing not more than

18,000 pounds with registration expiring at the same time as the
2applicable vehicle. A computer print-out of a page from the
3Secretary of State's official website setting forth the
4calendar months in which registration renewal notices were not
5sent to all owners of passenger vehicles of the first division
6and motor vehicles of the second division weighing not more
7than 8,000 pounds shall be admissible as evidence to establish
8the affirmative defense. The computer print-out shall be prima
9facie evidence of the correctness of the information contained
10in it. The changes made by this amendatory Act of the 99th
11General Assembly apply only to vehicle registrations that
12expire on or after the effective date of this amendatory Act of
13the 99th General Assembly.
