AMENDMENT TO HOUSE BILL 4462

2    AMENDMENT NO. ______. Amend House Bill 4462 on page 1,
3immediately after line 3, by inserting the following:
 
4    "Section 5. The State Police Act is amended by adding
5Section 40 as follows:
 
6    (20 ILCS 2610/40 new)
7    Sec. 40. Training; administration of epinephrine.
8    (a) This Section, along with Section 10.19 of the Illinois
9Police Training Act, may be referred to as the Annie LeGere
10Law.
11    (b) For the purposes of this Section, "epinephrine
12auto-injector" means a single-use device used for the automatic
13injection of a pre-measured dose of epinephrine into the human
14body prescribed in the name of the Department.
15    (c) The Department may conduct or approve a training
16program for State Police officers to recognize and respond to

1anaphylaxis including, but not limited to:
2        (1) how to recognize symptoms of an allergic reaction;
3        (2) how to respond to an emergency involving an
4    allergic reaction;
5        (3) how to administer an epinephrine auto-injector;
6        (4) how to respond to an individual with a known
7    allergy as well as an individual with a previously unknown
8    allergy;
9        (5) a test demonstrating competency of the knowledge
10    required to recognize anaphylaxis and administer an
11    epinephrine auto-injector; and
12        (6) other criteria as determined in rules adopted by
13    the Department.
14    (d) The Department may authorize a State Police officer who
15has completed the training program under subsection (c) to
16carry, administer, or assist with the administration of
17epinephrine auto-injectors whenever he or she is performing
18official duties.
19    (e) The Department must establish a written policy to
20control the acquisition, storage, transportation,
21administration, and disposal of epinephrine auto-injectors
22before it allows any State Police officer to carry and
23administer epinephrine auto-injectors.
24    (f) A physician, physician's assistant with prescriptive
25authority, or advanced practice registered nurse with
26prescriptive authority may provide a standing protocol or

1prescription for epinephrine auto-injectors in the name of the
2Department to be maintained for use when necessary.
3    (g) When a State Police officer administers epinephrine
4auto-injector in good faith, the officer and the Department,
5and its employees and agents, incur no liability, except for
6willful and wanton conduct, as a result of any injury or death
7arising from the use of an epinephrine auto-injector.
 
8    Section 10. The Illinois Police Training Act is amended by
9adding Section 10.19 as follows:
 
10    (50 ILCS 705/10.19 new)
11    Sec. 10.19. Training; administration of epinephrine.
12    (a) This Section, along with Section 40 of the State Police
13Act, may be referred to as the Annie LeGere Law.
14    (b) For purposes of this Section, "epinephrine
15auto-injector" means a single-use device used for the automatic
16injection of a pre-measured dose of epinephrine into the human
17body prescribed in the name of a local governmental agency.
18    (c) The Board shall conduct or approve an optional advanced
19training program for police officers to recognize and respond
20to anaphylaxis including the administration of an epinephrine
21auto-injector. The training must include, but is not limited
22to:
23        (1) how to recognize symptoms of an allergic reaction;
24        (2) how to respond to an emergency involving an

1    allergic reaction;
2        (3) how to administer an epinephrine auto-injector;
3        (4) how to respond to an individual with a known
4    allergy as well as an individual with a previously unknown
5    allergy;
6        (5) a test demonstrating competency of the knowledge
7    required to recognize anaphylaxis and administer an
8    epinephrine auto-injector; and
9        (6) other criteria as determined in rules adopted by
10    the Board.
11    (d) A local governmental agency may authorize a police
12officer who has completed an optional advanced training program
13under subsection (c) to carry, administer, or assist with the
14administration of epinephrine auto-injectors provided by the
15local governmental agency whenever he or she is performing
16official duties.
17    (e) A local governmental agency that authorizes its
18officers to carry and administer epinephrine auto-injectors
19under subsection (d) must establish a policy to control the
20acquisition, storage, transportation, administration, and
21disposal of epinephrine auto-injectors and to provide
22continued training in the administration of epinephrine
23auto-injectors.
24    (f) A physician, physician's assistant with prescriptive
25authority, or advanced practice registered nurse with

8of any injury or death arising from the use of an epinephrine
9auto-injector."; and
 
10on page 1, line 4, by replacing "Section 90" with "Section 15";
11and
 
12on page 15, immediately after line 10, by inserting the
13following:
 
14    "Section 20. The Illinois Food, Drug and Cosmetic Act is
15amended by changing Section 3.21 as follows:
 
16    (410 ILCS 620/3.21)  (from Ch. 56 1/2, par. 503.21)
17    Sec. 3.21. Except as authorized by this Act, the Illinois
18Controlled Substances Act, the Pharmacy Practice Act, the
19Dental Practice Act, the Medical Practice Act of 1987, the
20Veterinary Medicine and Surgery Practice Act of 2004, the
21Podiatric Medical Practice Act of 1987, or Section 22-30 of the
22School Code, Section 40 of the State Police Act, or Section

110.19 of the Illinois Police Training Act to sell or dispense a
2prescription drug without a prescription.

4    Section 90. The State Mandates Act is amended by adding
5Section 8.40 as follows:
 
6    (30 ILCS 805/8.40 new)
7    Sec. 8.40. Exempt mandate. Notwithstanding Sections 6 and 8
8of this Act, no reimbursement by the State is required for the
9implementation of any mandate created by Sections 5 and 10 of
10this amendatory Act of the 99th General Assembly.".
