AMENDMENT TO HOUSE BILL 4477 




2    AMENDMENT NO. ______. Amend House Bill 4477 by replacing 
3everything after the enacting clause with the following:

 
4    "Section 5. The Illinois Procurement Code is amended  by 
5adding Section 20-170 as follows:
 
6    (30 ILCS 500/20-170 new)
7    Sec. 20-170. Mobilization payments.
8    (a) As used in this Section, "mobilization payment" means 
9an advance payment to a contractor or subcontractor that 
10enables the contractor or subcontractor to purchase necessary 
11machinery and tools for a project. "Mobilization payment" may 
12also include other goods or services necessary for a project 
13when expressly provided for within the contract.
14    (b) All contracts under this Code entered into by the 
15Department of Transportation shall provide for mobilization 
16payments unless explicitly rejected by the contractor.

1    (c) When a contract under this Code entered into by the 
2Department of Transportation provides for mobilization 
3payments and the contractor is using the services of a 
4subcontractor, the subcontract shall include terms requiring 
5mobilization payments be made to the subcontractor.
6    Mobilization payments to a subcontractor shall be made on a 
7tiered system based on the total value of the subcontract:
8Subcontract value Mobilization percentage 
9Less than $10,000 25% 
10$10,000-$19,999 20% 
11$20,000-$39,999 18% 
12$40,000-$59,999 16% 
13$60,000-$79,999 14% 
14$80,000-$99,999 12% 
15$100,000-$249,999 10% 
16$250,000-$499,999 9% 
17$500,000-$750,000 8% 
18Over $750,000 7%".
