AMENDMENT TO HOUSE BILL 4477




2    AMENDMENT NO. ______. Amend House Bill 4477, AS AMENDED, by 
3replacing everything after the enacting clause with the 
4following:

 
5    "Section 5. The Illinois Procurement Code is amended  by 
6adding Section 30-50 as follows:
 
7    (30 ILCS 500/30-50 new)
8    Sec. 30-50. Mobilization payments.
9    (a) As used in this Section, "mobilization payment" means 
10an advance payment to a contractor or subcontractor that 
11enables the contractor or subcontractor to purchase necessary 
12machinery and tools for a project. "Mobilization payment" may 
13also include other goods or services necessary for a project 
14when expressly provided for within the contract. 
15    (b) All contracts under this Code entered into by the 
16Department of Transportation shall provide for mobilization

1payments unless explicitly rejected by the contractor.
2    (c) When a contract under this Code entered into by the 
3Department of Transportation provides for mobilization 
4payments and the contractor is using the services of a 
5subcontractor, the subcontract shall include terms requiring 
6mobilization payments be made to the subcontractor.
7    Mobilization payments to a subcontractor shall be made on a 
8tiered system based on the total value of the subcontract:
9Subcontract value Mobilization percentage 
10Less than $10,000 25% 
11$10,000-$19,999 20% 
12$20,000-$39,999 18% 
13$40,000-$59,999 16% 
14$60,000-$79,999 14% 
15$80,000-$99,999 12% 
16$100,000-$249,999 10% 
17$250,000-$499,999 9% 
18$500,000-$750,000 8% 
19Over $750,000 7% 
20    (d) This Section only applies to contracts entered into by 
21the Department of Transportation.".
