2 | | Be it enacted by the People of the State of Illinois, |
3 | | represented in the General Assembly:
|
4 | | Section 5. The Illinois Marriage and Dissolution of |
5 | | Marriage Act is amended by changing Section 404.1 as follows:
|
6 | | (750 ILCS 5/404.1) (from Ch. 40, par. 404.1)

7 | | Sec. 404.1.
(a) In an action for dissolution of marriage |
8 | | involving
minor children, or in a post-judgment proceeding |
9 | | involving minor children,
the
the court may on its own motion |
10 | | order the parties, excluding the minor
children, to attend an |
11 | | educational program concerning the effects of
dissolution of |
12 | | marriage on the children, if the court finds that it would
be |
13 | | in the best interests of the minor children. The program may be |
14 | | divided
into sessions, which in the aggregate shall not exceed |
15 | | 4 hours in duration.
The program shall be educational in nature |
16 | | and not designed for individual
therapy. |
17 | | (b) The facts adduced at any educational session resulting |
18 | | from a
referral under this Section shall not be considered in |
19 | | the adjudication of
a pending or subsequent action, nor shall |
20 | | any report resulting from such
educational session become part |
21 | | of the record of the case unless the
parties have stipulated in |
22 | | writing to the contrary.
