AMENDMENT TO HOUSE BILL 5004 




2    AMENDMENT NO. ______. Amend House Bill 5004 by replacing 
3everything after the enacting clause with the following:

 
 
4    "Section 5. The Humane Care for Animals Act is amended  by 
5adding Section 3.08 as follows:
 
6    (510 ILCS 70/3.08  new)
7    Sec. 3.08. Animal devocalization.
8    (a)   No person, except a veterinarian licensed in this 
9State, using anesthesia, may surgically debark or silence a dog 
10or cat.
11    (b)   Any person or business selling a dog or cat shall 
12disclose whether the dog or cat has been surgically debarked or 
13silenced.
14    (c)   Any person convicted of violation of subsection (a) of 
15this Section is guilty of a Class 3 felony and may be fined not 
16more than $2,500, or fined and imprisoned. A court may also

1order any person convicted under subsection (a) of  this Section 
2to submit to a mental health evaluation as determined by the 
3court and undergo any recommended counseling or treatment. In 
4addition to any other penalty provided by law, a person 
5convicted under subsection (a) of this Section may be barred 
6from owning or possessing any animals, or living on the same 
7property with any person  who owns or possesses animals, for a 
8period of time deemed appropriate by the court, and required to 
9take humane education and pet ownership and dog training 
10classes as ordered by the court.".
