| 3 | | with reference to page and line numbers of Senate Amendment No. |
| 4 | | 1, by replacing lines 1 through 5 on page 18 with |
| 5 | | "Notwithstanding any other provision to the contrary, the |
| 6 | | Department shall not seek recovery of overpayments, |
| 7 | | adjustments, or other amounts due that are more than 6 years |
| 8 | | old, except in the following circumstances: (i) there is an |
| 9 | | active investigation initiated by the Department of State |
| 10 | | Police or any other State or federal law enforcement agency |
| 11 | | during the 6-year period, in which case the 6-year limitation |
| 12 | | for the recovery of overpayments, adjustments, or other amounts |
| 13 | | due is tolled for the period of time the matter is under |
| 14 | | investigation or prosecution; or (ii) the Centers for Medicare |
| 15 | | and Medicaid Services attempts to recover federal financial |
| 16 | | participation moneys from the Department resulting from an |
| 17 | | overpayment more than 6 years old and the Centers for Medicare |
| 18 | | and Medicaid Services determines that the overpayment is not |
