| 2 | | AMENDMENT NO. ______. Amend House Bill 5576, AS AMENDED, on |
| 3 | | page 7, immediately below line 5, by inserting
the following: |
| 4 | | "(d) If a plan or issuer utilizes a network of providers, |
| 5 | | nothing in this Section shall be construed to require coverage |
| 6 | | or to prohibit the plan or issuer from imposing cost-sharing |
| 7 | | for items or services described in this Section that are |
| 8 | | provided or delivered by an out-of-network provider, unless the |
| 9 | | plan or issuer does not have in its network a provider who is |
| 10 | | able to or is willing to provide the applicable items or |
| 11 | | services.".
