SYNOPSIS AS INTRODUCED:
 
20 ILCS 505/39.4 new

    Amends the Children and Family Services Act. Creates the Enhanced Services for Children with Disabilities Task Force to examine and review the Department of Children and Family Services' protocols and procedures for interviewing children with disabilities who are victims of abuse or neglect. Sets forth the task force's duties which shall include: (i) examining reports made to the Department's statewide toll-free telephone number that concern children with disabilities who later interviewed in an abuse or neglect case; and (ii) developing best practices and strategies for Department caseworkers to utilize when interviewing children with disabilities, including disability-specific approaches and services designed to make the child more compliant and focused during the interview process. Provides that the task force shall consist of 21 appointed members who shall serve without compensation and shall be considered members with voting rights. Provides that the task force shall meet and hold hearings as it deems necessary and shall receive the cooperation of any State agency it deems appropriate to assist the task force in carrying out its duties. Requires the task force to submit a report of its findings and recommendations to the Governor, the Department, and the General Assembly no later than December 31, 2018 and provides that the task force is abolished and the provisions creating the task force are repealed on January 1, 2019. Effective immediately.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Children and Family Services Act is amended
5by adding Section 39.4 as follows:
 
6    (20 ILCS 505/39.4 new)
7    Sec. 39.4. Enhanced Services for Children with
8Disabilities Task Force.
9    (a) As used in this Section:
10    "Department" means the Department of Children and Family
11Services.
12    "Director" means the Director of the Department of Children
13and Family Services.
14    (b) The Enhanced Services for Children with Disabilities
15Task Force is created to examine and review the Department's
16protocols and procedures for interviewing children with
17disabilities who are victims of abuse or neglect.
18    (c) The task force shall have the following duties:
19        (1) Examine reports made to the statewide toll-free
20    telephone number established under Section 7.6 of the
21    Abused and Neglected Child Reporting Act that concern
22    children with disabilities who later interviewed in an
23    abuse or neglect case.

1        (2) Identify the specific disabilities of those
2    children who interviewed in an abuse or neglect case.
3        (2) Review existing Department protocols for
4    interviewing children with disabilities.
5        (3) Develop best practices and strategies for
6    Department caseworkers to utilize when interviewing
7    children with disabilities, including disability-specific
8    approaches and services designed to make the child more
9    compliant and focused during the interview process.
10        (4) Develop and provide recommendations to the
11    Department regarding rules and procedures for interviewing
12    children with disabilities.
13    (d) The task force shall consist of 21 members as follows:
14        (1) The Director of the Department, or his or her
15    designee.
16        (2) Two investigators from the Department appointed by
17    the Director.
18        (3) Two members of the Coalition Against Sexual Abuse
19    of Children with Disabilities (CASACD) appointed by the
20    Director.
21        (4) One staff member from the University of Illinois at
22    Chicago's Institute on Disability and Human Development
23    appointed by the Director.
24        (5) One forensic interviewer appointed by the
25    Director.
26        (6) One representative from a group that advocates on

1    behalf of children with disabilities appointed by the
2    Director.
3        (7) Two licensed clinical social workers appointed by
4    the Director.
5        (8) The Secretary of the Department of Human Services,
6    or his or her designee.
7        (9) One representative from the Department of Human
8    Services' Division of Developmental Disabilities appointed
9    by the Secretary of the Department of Human Services.
10        (10) The Director of the Illinois Council of
11    Developmental Disabilities, or his or her designee.
12        (11) Two members appointed by the Speaker of the House
13    of Representatives.
14        (12) Two members appointed by the Minority Leader of
15    the House of Representatives.
16        (13) Two members appointed by the President of the
17    Senate.
18        (14) Two members appointed by the Minority Leader of
19    the Senate.
20    Members of the task force shall serve without compensation
21and shall be considered members with voting rights. A quorum of
22the task force shall consist of a majority of the members of
23the task force.
24    (e) The task force shall meet and hold hearings as it deems
25necessary and shall receive the cooperation of any State agency
26it deems appropriate to assist the task force in carrying out

1its duties.
2    (f) The Department shall provide administrative support to
3the task force.
4    (g) The task force shall submit a report of its findings
5and recommendations to the Governor, the Department, and the
6General Assembly no later than December 31, 2018.
7    (h) The task force is abolished and this Section is
8repealed on January 1, 2019.
 
9    Section 99. Effective date. This Act takes effect upon
10becoming law.
