SYNOPSIS AS INTRODUCED:
 
720 ILCS 5/24-2.3 new

    Amends the Criminal Code of 2012. Creates the offense of unlawful possession of a flame-thrower. Provides that a person commits the offense when he or she knowingly possesses or carries a flame-thrower. Creates the offense of unlawful use of flame-thrower. Provides that a person commits the offense when he or she knowingly discharges a burning stream of combustible or flammable liquid from a flame-thrower. Provides that a person who either unlawfully possesses or uses a flame-thrower is guilty of a Class 4 felony. Defines flame-thrower a non-stationary and transportable device that is designed or intended to emit or propel a burning stream of combustible or flammable liquid a distance of at least 10 feet. Effective immediately.

1    AN ACT concerning criminal law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Criminal Code of 2012 is amended by adding
5Section 24-2.3 as follows:
 
6    (720 ILCS 5/24-2.3 new)
7    Sec. 24-2.3. Unlawful use or possession of a flamethrower.
8    (a) As used in this Section, "flame-thrower" means any
9non-stationary and transportable device designed or intended
10to emit or propel a burning stream of combustible or flammable
11liquid a distance of at least 10 feet.
12    (b) A person commits unlawful possession of a flame-thrower
13when he or she knowingly possesses or carries a flame-thrower.
14    (c) A person commits unlawful use of a flame-thrower when
15he or she knowingly discharges a burning stream of combustible
16or flammable liquid from a flame-thrower.
17    (d) Sentence. Any person violates subsection (b) or (c) of
18this Section is guilty of a Class 4 felony.
 
19    Section 99. Effective date. This Act takes effect upon
20becoming law.
