AMENDMENT TO HOUSE BILL 5908

2    AMENDMENT NO. ______. Amend House Bill 5908 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Park District Code is amended by adding
5Section 8-23a as follows:
 
6    (70 ILCS 1205/8-23a new)
7    Sec. 8-23a. Application for volunteers; disclosure of
8child sex offenses; penalty for failure to disclose.
9    (a) For purposes of this Section:
10    "Child sex offender" has the meaning provided in paragraph
11(1) of subsection (d) of Section 11-9.3 of the Criminal Code of
122012.
13    "Volunteer" means any individual who without compensation
14or benefits reports to, and is under the direct supervision of,
15a park district's administrative staff and provides personal
16services to a park district recreational program that is

1offered to children.
2    (b) Every park district shall require volunteers to
3complete an application prior to beginning any work as a
4volunteer. The application shall include, but shall not be
5limited to, a question for the applicant to answer concerning
6whether they have been convicted of or found to be a child sex
7offender. No park district shall knowingly engage a volunteer
8who has been convicted of or found to be a child sex offender
9and shall terminate the services of the volunteer upon
10discovery of such an offender.
11    (c) If a current volunteer with a park district is
12convicted of or found to be a child sex offender, the volunteer
13shall immediately disclose the conviction or finding to the
14park district.
15    (d) Failure of a volunteer to disclose that they are a
16child sex offender pursuant to this Section is a Class A
17misdemeanor, except that a second or subsequent violation is a
18Class 4 felony. Any person convicted of a violation under this
19subsection shall, in addition to any other penalty required by
20law, be required to serve a minimum period of 7 days
21confinement in the local county jail, and the court shall
22impose a mandatory minimum fine of $500. These fines shall be
23deposited in the Sex Offender Registration Fund.
 
24    Section 99. Effective date. This Act takes effect upon
25becoming law.".
