| 1 | | AN ACT concerning transportation.

| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Criminal Code of 2012 is amended by changing |
| 5 | | Section 12-5.02 as follows:
|
| 6 | | (720 ILCS 5/12-5.02)

| 7 | | Sec. 12-5.02. Vehicular endangerment.
|
| 8 | | (a) A person commits vehicular endangerment when he or she |
| 9 | | strikes a motor vehicle by causing
an object to fall from an |
| 10 | | overpass or other elevated location in the direction of a |
| 11 | | moving
motor vehicle with the intent to strike a motor vehicle |
| 12 | | while it is traveling upon a highway in this State.

| 13 | | (b) Sentence. Vehicular endangerment is a Class 2 felony, |
| 14 | | unless
death results, in which case vehicular endangerment is a |
| 15 | | Class 1
felony.

| 16 | | (c) Definitions. For purposes of this Section:
|
| 17 | | "Elevated location" means a bridge, overpass, highway |
| 18 | | ramp, building, artificial structure, hill, mound, or natural |
| 19 | | elevation above or adjacent to and above a highway. |
| 20 | | "Object" means any object or substance that by its size, |
| 21 | | weight, or
consistency is likely to cause great bodily harm to |
| 22 | | any occupant of a motor
vehicle.

| 23 | | "Overpass" means any structure that passes over a highway.
|
