SYNOPSIS AS INTRODUCED:

    Amends the General Provisions Article of the Illinois Pension Code. Requires every pension fund or retirement system under the Code to develop and implement, by no later than June 30, 2017, a process to identify annuitants who are deceased. The process shall require the pension fund or retirement system to check for any deceased annuitants at least once per month and shall include the use of commonly accepted methods to identify persons who are deceased, which include, but are not limited to, the use of a third party entity that specializes in the identification of deceased persons, the use of data provided by the Social Security Administration, the use of data provided by the Department of Public Health's Office of Vital Records, or the use of any other method that is commonly used by other states to identify deceased persons. Amends the Vital Records Act to make a conforming change. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

1    AN ACT concerning public employee benefits.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Pension Code is amended by adding
5Section 1-140 as follows:
 
6    (40 ILCS 5/1-140 new)
7    Sec. 1-140. Identification of deceased annuitants. Every
8pension fund or retirement system under this Code shall develop
9and implement, by no later than June 30, 2017, a process to
10identify annuitants who are deceased. The process shall require
11the pension fund or retirement system to check for any deceased
12annuitants at least once per month and shall include the use of
13any commonly used methods to identify persons who are deceased,
14which include, but are not limited to, the use of a third party
15entity that specializes in the identification of deceased
16persons, the use of data provided by the Social Security
17Administration, the use of data provided by the Department of
18Public Health's Office of Vital Records, or the use of any
19other method that is commonly used by other states to identify
20deceased persons.
 
21    Section 10. The Vital Records Act is amended by adding
22Section 24.5 as follows:

2    Sec. 24.5. Access to records; pension funds and retirement
3systems. Any information contained in the vital records shall
4be made available to any pension fund or retirement system
5under the Illinois Pension Code pursuant to Section 1-140 of
6the Illinois Pension Code.
 
7    Section 90. The State Mandates Act is amended by adding
8Section 8.39 as follows:
 
9    (30 ILCS 805/8.39 new)
10    Sec. 8.39. Exempt mandate. Notwithstanding Sections 6 and 8
11of this Act, no reimbursement by the State is required for the
12implementation of any mandate created by this amendatory Act of
13the 99th General Assembly.
 
14    Section 99. Effective date. This Act takes effect upon
15becoming law.
