| 2 | | AMENDMENT NO. ______. Amend House Bill 6041 on page 2, in |
| 3 | | line 8, by changing "Five One" to "One"; and

| 4 | | by replacing line 9 on page 5 through line 1 on page 6 with the |
| 5 | | following: |
| 6 | | "same. For purposes of this Section, serious injury would be |
| 7 | | caused to the district from which the transfer is proposed to |
| 8 | | be made if the disconnection of the territory, and the loss of |
| 9 | | assessed valuation by reason thereof, would impair the ability |
| 10 | | of the district to render fully adequate fire protection and |
| 11 | | related emergency services to the territory remaining within |
| 12 | | the district after the disconnection. In making this |
| 13 | | determination, the court may consider, without limitation: the |
| 14 | | tax revenues and other financial resources available to the |
| 15 | | district after the disconnection; the facilities and equipment |
| 16 | | that will remain within the district after the disconnection; |
| 17 | | and the financial obligations, including remaining non-bonded |
