SYNOPSIS AS INTRODUCED:
 
20 ILCS 3305/17.5

    Amends the Illinois Emergency Management Agency Act. Provides that the Homeland Security Emergency Preparedness Trust fund shall be considered always appropriated for the purposes of disbursements, as provided in the Act, and shall be paid out and disbursed only as provided herein, and shall not, at any time, be appropriated or diverted to any other use or purpose. Effective immediately.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Emergency Management Agency Act is
5amended by changing Section 17.5 as follows:
 
6    (20 ILCS 3305/17.5)
7    Sec. 17.5. Homeland Security Emergency Preparedness Fund.
8The Homeland Security Emergency Preparedness Trust Fund is
9created as a federal trust fund in the State treasury. The
10Trust Fund shall be held separate and apart from all public
11moneys or funds of this State. All Homeland Security moneys
12received by the Agency under Section 17 from a federal
13department or agency shall be deposited into the Trust Fund.
14Interest earned by the investment or deposit of moneys
15accumulated in the Trust Fund shall be deposited into the Trust
16Fund. The Trust Fund shall be considered always appropriated
17for the purposes of disbursements, as provided in this Section,
18and shall be paid out and disbursed only as provided herein,
19and shall not, at any time, be appropriated or diverted to any
20other use or purpose. The Agency is authorized to expend any
21moneys in the Trust Fund for the specific purposes established
22by the terms and conditions of the federal awards received by
23the Agency and in any amount that the Agency deems necessary to

1make grants and pay expenses in connection with its emergency
2management and preparedness programs.
