Amends the Illinois Emergency Management Agency Act. Provides that the Homeland Security Emergency Preparedness Trust fund shall be considered always appropriated for the purposes of disbursements, as provided in the Act, and shall be paid out and disbursed only as provided herein, and shall not, at any time, be appropriated or diverted to any other use or purpose. Effective immediately.

| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Illinois Emergency Management Agency Act is |
| 5 | | amended by changing Section 17.5 as follows:
|
| 6 | | (20 ILCS 3305/17.5) |
| 7 | | Sec. 17.5. Homeland Security Emergency Preparedness Fund. |
| 8 | | The Homeland Security Emergency Preparedness Trust Fund is |
| 9 | | created as a federal trust fund in the State treasury. The |
| 10 | | Trust Fund shall be held separate and apart from all public |
| 11 | | moneys or funds of this State. All Homeland Security moneys |
| 12 | | received by the Agency under Section 17 from a federal |
| 13 | | department or agency shall be deposited into the Trust Fund. |
| 14 | | Interest earned by the investment or deposit of moneys |
| 15 | | accumulated in the Trust Fund shall be deposited into the Trust |
| 16 | | Fund. The Trust Fund shall be considered always appropriated |
| 17 | | for the purposes of disbursements, as provided in this Section, |
| 18 | | and shall be paid out and disbursed only as provided herein, |
| 19 | | and shall not, at any time, be appropriated or diverted to any |
| 20 | | other use or purpose. The Agency is authorized to expend any |
| 21 | | moneys in the Trust Fund for the specific purposes established |
| 22 | | by the terms and conditions of the federal awards received by |
| 23 | | the Agency and in any amount that the Agency deems necessary to |
