SYNOPSIS AS INTRODUCED:
 
720 ILCS 5/26-2  from Ch. 38, par. 26-2

    Amends the Criminal Code of 2012. Provides that a person also commits interference with emergency communication when he or she knowingly prevents or attempts to prevent a person who reasonably believes an emergency is taking place from contacting a 9-1-1 emergency telephone system, obtaining medical assistance, or making a report to a law enforcement official. Provides that a violation is a Class A misdemeanor.

1    AN ACT concerning criminal law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Criminal Code of 2012 is amended by changing
5Section 26-2 as follows:
 
6    (720 ILCS 5/26-2)  (from Ch. 38, par. 26-2)
7    Sec. 26-2. Interference with emergency communication.
8    (a) A person commits interference with emergency
9communication when he or she knowingly, intentionally and
10without lawful justification interrupts, disrupts, impedes, or
11otherwise interferes with the transmission of a communication
12over a citizens band radio channel, the purpose of which
13communication is to inform or inquire about an emergency.
14    (a-5) A person commits interference with emergency
15communication when he or she knowingly prevents or attempts to
16prevent a person who reasonably believes an emergency is taking
17place from contacting a 9-1-1 emergency telephone system,
18obtaining medical assistance, or making a report to a law
19enforcement official.
20    (b) For the purpose of this Section, "emergency" means a
21condition or circumstance in which an individual is or is
22reasonably believed by the person transmitting the
23communication to be in imminent danger of serious bodily injury

1or in which property is or is reasonably believed by the person
2transmitting the communication to be in imminent danger of
3damage or destruction.
4    (c) Sentence.
5        (1) Interference with emergency communication under
6    subsection (a) of this Section is a Class B misdemeanor,
7    except as otherwise provided in paragraph (2) or (3) of
8    this subsection (c).
9        (2) Interference with emergency communication under
10    subsection (a) of this Section, where serious bodily injury
11    or property loss in excess of $1,000 results, is a Class A
12    misdemeanor.
13        (3) Interference with emergency communication under
14    subsection (a-5) of this Section is a Class A misdemeanor.
