Amends the Illinois Public Aid Code. Adds the percentage of Medicaid funded residents as one of the factors the Department of Healthcare and Family Services must considered
in grouping nursing facilities for purposes of payment. Provides that a resident of a nursing facility whose application for long term care benefits is awaiting final action shall be included in the calculation as a Medicaid funded resident.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Illinois Public Aid Code is amended by |
5 | | changing Section 5-5.1 as follows:
|
6 | | (305 ILCS 5/5-5.1) (from Ch. 23, par. 5-5.1)
|
7 | | Sec. 5-5.1. Grouping of Facilities. The Department of |
8 | | Healthcare and Family Services shall, for purposes of payment, |
9 | | provide for
groupings of nursing facilities. Factors to be |
10 | | considered
in grouping facilities may include, but are not |
11 | | limited to,
size, age, patient mix , percentage of Medicaid |
12 | | funded residents, or geographical area.

13 | | The groupings developed under this Section shall be
|
14 | | considered in determining reasonable cost reimbursement
|
15 | | formulas. However, this Section shall not preclude the
|
16 | | Department from recognizing and evaluating the cost of
capital |
17 | | on a facility-by-facility basis.
|
18 | | A resident of a nursing facility whose application for long |
19 | | term care benefits is awaiting final action shall be included |
20 | | in the calculation as a Medicaid funded resident. |
