Amends the Illinois Highway Code. Provides that it is unlawful for the Department of Transportation, its employees and its agents to knowingly misrepresent any facts in relation to the submission of plans, maps, specifications, costs of construction, bids, or contracts for any Department project. Provides that a violation of the Section shall render any contract to which the falsification, distortion, or misrepresentation is related void as a matter of law and the Department shall rebid all affected projects.

1 | | AN ACT concerning transportation.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Illinois Highway Code is amended by adding |
5 | | Section 4-106 as follows: |
6 | | (605 ILCS 5/4-106 new) |
7 | | Sec. 4-106. Misrepresentation. |
8 | | (a) In relation to the submission of plans, maps, |
9 | | specifications, costs of construction, bids, or contracts for |
10 | | any Department project, it is unlawful for the Department, its |
11 | | employees and its agents to knowingly falsify, distort, or |
12 | | misrepresent any facts concerning, but not limited to, the |
13 | | following: |
14 | | (1) the character, quality, cost, or quantity of |
15 | | material already used or to be used; |
16 | | (2) the quality or quantity of any work already |
17 | | performed or to be performed; and |
18 | | (3) any other related costs. |
19 | | (b) Any violation of subsection (a) of this Section shall |
20 | | render any contract to which the falsification, distortion, or |
21 | | misrepresentations is related void as a matter of law, and the |
22 | | Department shall rebid all affected projects.
