| 1 | | AN ACT concerning transportation.
|
| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Illinois Highway Code is amended by adding |
| 5 | | Section 4-106 as follows:
|
| 6 | | (605 ILCS 5/4-106 new) |
| 7 | | Sec. 4-106. Misrepresentation. |
| 8 | | (a) In relation to the submission of plans, maps, |
| 9 | | specifications, costs of construction, bids, or contracts for |
| 10 | | any Department project, it is unlawful for the Department, its |
| 11 | | employees and its agents to knowingly falsify, distort, or |
| 12 | | misrepresent any facts concerning, but not limited to, the |
| 13 | | following: |
| 14 | | (1) the character, quality, cost, or quantity of |
| 15 | | material already used or to be used; |
| 16 | | (2) the quality or quantity of any work already |
| 17 | | performed or to be performed; and |
| 18 | | (3) any other related costs. |
| 19 | | (b) A violation of subsection (a) of this Section shall be |
| 20 | | punishable by a fine of not more than $10,000 or by |
| 21 | | imprisonment of not more than 5 years, or both.
