| 1 | HOUSE RESOLUTION
| ||||||
| 2 | WHEREAS, In the State of Illinois, an eligible law student | ||||||
| 3 | and an eligible graduate of law school that is not yet licensed | ||||||
| 4 | to practice law in any jurisdiction, if he or she satisfies | ||||||
| 5 | specific requirements, can be granted a temporary license to | ||||||
| 6 | perform specified legal services under Illinois Supreme Court | ||||||
| 7 | Rule 711; and
| ||||||
| 8 | WHEREAS, Under Rule 711, eligible law students and eligible | ||||||
| 9 | graduates of law schools may render services under the | ||||||
| 10 | supervision of a member of the Illinois bar, such as | ||||||
| 11 | negotiating in the settlement of claims; representing clients | ||||||
| 12 | in mediation and other non-litigation matters; engaging in the | ||||||
| 13 | preparation and drafting of legal instruments; and appearing in | ||||||
| 14 | trial courts, courts of review, and administrative tribunals of | ||||||
| 15 | this State, subject to qualifications; and
| ||||||
| 16 | WHEREAS, Eligible law students and eligible graduates of | ||||||
| 17 | law school may perform such permitted legal services in the | ||||||
| 18 | course of the student's or graduate's work with one or more of | ||||||
| 19 | the following organizations or programs: a legal aid bureau, | ||||||
| 20 | legal assistance program, organization, or clinic chartered by | ||||||
| 21 | the State of Illinois or approved by an American Bar | ||||||
| 22 | Association-approved law school; the public defender's office; | ||||||
| 23 | or a law office of the State or any of its subdivisions; and
| ||||||

| 1 | WHEREAS, The Illinois General Assembly is the legislative | ||||||
| 2 | body of the State of Illinois authorized to negotiate, prepare, | ||||||
| 3 | draft, and enact legislation on behalf of the people of | ||||||
| 4 | Illinois; and
| ||||||
| 5 | WHEREAS, The Illinois General Assembly has multiple | ||||||
| 6 | offices with attorneys who are members of the Illinois bar that | ||||||
| 7 | analyze and draft legislation and research related legal | ||||||
| 8 | issues; and | ||||||
| 9 | WHEREAS, As currently written, Rule 711 does not clearly | ||||||
| 10 | authorize eligible law students and eligible law school | ||||||
| 11 | graduates to perform legal services for the Illinois General | ||||||
| 12 | Assembly; and
| ||||||
| 13 | WHEREAS, Eligible law students and eligible law school | ||||||
| 14 | graduates that are temporarily licensed under Rule 711 could | ||||||
| 15 | greatly benefit from the advanced experience gained through the | ||||||
| 16 | opportunity of working closely with members of the General | ||||||
| 17 | Assembly while performing legal services related to the | ||||||
| 18 | legislative process under the supervision of members of the | ||||||
| 19 | Illinois bar; and
| ||||||
| 20 | WHEREAS, The General Assembly could greatly benefit from | ||||||
| 21 | the additional assistance and particularized knowledge of | ||||||
| |||||||
| |||||||
| 1 | eligible law students and eligible law school graduates that | ||||||
| 2 | are temporarily licensed under Rule 711 to perform legal | ||||||
| 3 | services related to the legislative process; therefore, be it
| ||||||
| 4 | RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE | ||||||
| 5 | NINETY-NINTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that we | ||||||
| 6 | urge the Supreme Court of Illinois to amend its Rule 711(b) to | ||||||
| 7 | specifically list the Illinois General Assembly as one of the | ||||||
| 8 | agencies through which services may be performed as a part of | ||||||
| 9 | the temporary licensing process, authorizing eligible law | ||||||
| 10 | students and eligible law school graduates to perform legal | ||||||
| 11 | services under the Rule; and be it further
| ||||||
| 12 | RESOLVED, That suitable copies of this resolution be | ||||||
| 13 | delivered to the members of the Illinois Supreme Court Rules | ||||||
| 14 | Committee and the Director of the Administrative Office of the | ||||||
| 15 | Illinois Courts.
