HOUSE RESOLUTION

 
2    WHEREAS, In the State of Illinois, an eligible law student
3and an eligible graduate of law school that is not yet licensed
4to practice law in any jurisdiction, if he or she satisfies
5specific requirements, can be granted a temporary license to
6perform specified legal services under Illinois Supreme Court
7Rule 711; and
 
8    WHEREAS, Under Rule 711, eligible law students and eligible
9graduates of law schools may render services under the
10supervision of a member of the Illinois bar, such as
11negotiating in the settlement of claims; representing clients
12in mediation and other non-litigation matters; engaging in the
13preparation and drafting of legal instruments; and appearing in
14trial courts, courts of review, and administrative tribunals of
15this State, subject to qualifications; and
 
16    WHEREAS, Eligible law students and eligible graduates of
17law school may perform such permitted legal services in the
18course of the student's or graduate's work with one or more of
19the following organizations or programs: a legal aid bureau,
20legal assistance program, organization, or clinic chartered by
21the State of Illinois or approved by an American Bar
22Association-approved law school; the public defender's office;
23or a law office of the State or any of its subdivisions; and

1    WHEREAS, The Illinois General Assembly is the legislative
2body of the State of Illinois authorized to negotiate, prepare,
3draft, and enact legislation on behalf of the people of
4Illinois; and
 
5    WHEREAS, The Illinois General Assembly has multiple
6offices with attorneys who are members of the Illinois bar that
7analyze and draft legislation and research related legal
8issues; and
 
9    WHEREAS, As currently written, Rule 711 does not clearly
10authorize eligible law students and eligible law school
11graduates to perform legal services for the Illinois General
12Assembly; and
 
13    WHEREAS, Eligible law students and eligible law school
14graduates that are temporarily licensed under Rule 711 could
15greatly benefit from the advanced experience gained through the
16opportunity of working closely with members of the General
17Assembly while performing legal services related to the
18legislative process under the supervision of members of the
19Illinois bar; and
 
20    WHEREAS, The General Assembly could greatly benefit from
21the additional assistance and particularized knowledge of

1eligible law students and eligible law school graduates that
2are temporarily licensed under Rule 711 to perform legal
3services related to the legislative process; therefore, be it
 
4    RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE
5NINETY-NINTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that we
6urge the Supreme Court of Illinois to amend its Rule 711(b) to
7specifically list the Illinois General Assembly as one of the
8agencies through which services may be performed as a part of
9the temporary licensing process, authorizing eligible law
10students and eligible law school graduates to perform legal
11services under the Rule; and be it further
 
12    RESOLVED, That suitable copies of this resolution be
13delivered to the members of the Illinois Supreme Court Rules
14Committee and the Director of the Administrative Office of the
15Illinois Courts.
