AMENDMENT TO SENATE BILL 13 




2    AMENDMENT NO. ______. Amend Senate Bill 13 by replacing 
3everything after the enacting clause with the following:

 
4    "Section 5. The Child Care Act of 1969 is amended  by adding 
5Section 8.5 as follows:
 
6    (225 ILCS 10/8.5 new)
7    Sec. 8.5. Failure to report. The Department shall address 
8through rules the Department's policy regarding individual 
9staff at child care facilities or child welfare agencies who 
10fail to report suspected abuse or neglect of children within 
11the facility, as required by the Abused and Neglected Child 
12Reporting Act. When the Department learns of the facility 
13staff's failure to report, it shall take immediate action 
14directly with the individual staff involved. The Department 
15shall also investigate whether the staff failure to report was 
16a single incident or part of a larger incident involving

1additional staff members who fail to report, or even if the 
2failure to report abuse or neglect is a system-wide problem 
3within the entity. The Department rules shall also include the 
4use of corrective action plans and the use of supervisory teams 
5to review and reiterate staff understanding of their reporting 
6obligations and assure staff that the entity's administration 
7requires staff to report suspected abuse and neglect. The 
8Department shall establish these rules no later than January 1, 
92016.
 

10    Section 99. Effective date. This Act takes effect upon 
11becoming law.".
