AMENDMENT TO SENATE BILL 37

AMENDMENT NO. ______. Amend Senate Bill 37 by replacing everything after the enacting clause with the following:

"Section 5. The Election Code is amended by adding Section 1A-50 as follows:

(10 ILCS 5/1A-50 new)

Sec. 1A-50. Municipal websites; election information. The State Board of Elections shall adopt rules under Section 1-9-10 of the Illinois Municipal Code.

Section 10. The Illinois Municipal Code is amended by adding Section 1-9-10 as follows:

(65 ILCS 5/1-9-10 new)

Sec. 1-9-10. Municipal websites; election information.

(a) In the 6 months before an election, municipalities shall make available a section or page of their website for online local election information that includes candidates running for municipal, county, and State offices whose names will appear on the local ballot. This section or page shall include a list of the name of each registered candidate for each office. If a municipality does not have a website, it is not required to create one for the purposes of this Section.

(b) Candidates may submit the following for inclusion on the municipal websites:

(1) a photograph of the candidate;

(2) the candidate's contact information, not to exceed 100 characters for his or her choice of email, phone number, or address of candidate;

(3) the candidate's party affiliation, not to exceed 50 characters;

(4) one website link;

(5) one video link; and

(6) up to 250 characters of other information about the candidate.

(c) Any candidate providing information under subsection (b) of this Section shall submit for inclusion on the municipal websites a statement verifying that the information submitted is authentic.

(d) The municipality is not responsible for creating this content. If the candidate does not provide any information to a municipality, that municipality is only responsible for listing the name of each candidate to appear on the ballot. The municipality is not responsible for the editing or reformatting of any data provided by the candidate. Any municipality may, by ordinance or resolution, establish criteria for the submission and format of the information under subsection (b).

(e) Any municipality's local government access television station may also post this information on their channel to run during available air time in the months leading up to the election.

(f) The State Board of Elections shall adopt rules to enforce the provisions of this Section. Those rules shall be made public and posted on the State Board of Elections' website. Each municipality shall publish rules of access and page moderation on their website.".
