Amends the Illinois Vehicle Code. Requires every low-speed electric bicycle to at all times be equipped with a lamp visible from the front. Requires every moped to be equipped with a lamp. Requires every motorcycle, motor-driven cycle, moped, and low-speed electric bicycle to at all times have at least one lighted lamp when operating on a highway in this State.

| 1 | | AN ACT concerning transportation.
|
| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Illinois Vehicle Code is amended by changing |
| 5 | | Sections 11-1507, 11-1507.1, and 12-201 as follows:
|
| 6 | | (625 ILCS 5/11-1507) (from Ch. 95 1/2, par. 11-1507)

| 7 | | Sec. 11-1507. Lamps and other equipment on bicycles. |
| 8 | | (a) Every bicycle
when in use at nighttime and every |
| 9 | | low-speed bicycle at all times, shall be equipped with a
lamp |
| 10 | | on the front which shall emit a white light visible from a |
| 11 | | distance
of at least 500 feet to the front and with a red |
| 12 | | reflector on the rear
of a type approved by the Department |
| 13 | | which shall be visible from all
distances from 100 feet to 600 |
| 14 | | feet to the rear when directly in front
of lawful lower beams |
| 15 | | of headlamps on a motor vehicle. A lamp emitting
a red light |
| 16 | | visible from a distance of 500 feet to the rear may be used
in |
| 17 | | addition to the red reflector.

| 18 | | (b) A bicycle shall not be equipped with nor shall any |
| 19 | | person use
upon a bicycle any siren. This subsection (b) does |
| 20 | | not apply to a bicycle that is a police vehicle or fire |
| 21 | | department vehicle.
|
| 22 | | (c) Every bicycle shall be equipped with a brake which will
|
| 23 | | adequately control movement of and stop and hold such bicycle.

| 1 | | (d) No person shall sell a new bicycle or pedal for use on |
| 2 | | a bicycle
that is not equipped with a reflex reflector |
| 3 | | conforming to
specifications prescribed by the Department, on |
| 4 | | each pedal, visible from
the front and rear of the bicycle |
| 5 | | during darkness from a distance of 200
feet.

| 6 | | (e) No person shall sell or offer for sale a new bicycle |
| 7 | | that is not
equipped with side reflectors. Such reflectors |
| 8 | | shall be visible from
each side of the bicycle from a distance |
| 9 | | of 500 feet and shall be essentially
colorless or red to
the |
| 10 | | rear of the center of the bicycle and essentially colorless or |
| 11 | | amber
to the front of the
center of the bicycle provided. The |
| 12 | | requirements of this paragraph may
be met by reflective |
| 13 | | materials which shall be at least 3/16 of an inch
wide on each |
| 14 | | side of each tire or rim to indicate as clearly as possible
the |
| 15 | | continuous circular shape and size of the tires or rims of such
|
| 16 | | bicycle and which reflective materials may be of the same color |
| 17 | | on both
the front and rear tire or rim. Such reflectors shall |
| 18 | | conform to
specifications prescribed by the Department.

| 19 | | (f) No person shall sell or offer for sale a new bicycle |
| 20 | | that is not
equipped with an essentially colorless front-facing |
| 21 | | reflector.
|

| 10 | | Sec. 12-201. When lighted lamps are required.
|
| 11 | | (a) When operated upon any highway in this State, every |
| 12 | | motorcycle, motor-driven cycle, moped, and low-speed electric |
| 13 | | bicycle shall at
all times exhibit at least one lighted lamp, |
| 14 | | showing a white light visible
for at least 500 feet in the
|
| 15 | | direction the motorcycle, motor-driven cycle, moped, or |
| 16 | | low-speed electric bicycle is proceeding. However, in lieu of |
| 17 | | the such lighted
lamp, a motorcycle, motor-driven cycle, moped, |
| 18 | | or low-speed electric bicycle may be equipped with and use a |
| 19 | | means of modulating the
upper beam of the head lamp between |
| 20 | | high and a lower brightness. No such
head lamp shall be |
| 21 | | modulated, except to otherwise comply with this Code,
during |
| 22 | | times when lighted lamps are required for other motor vehicles.
|
| 23 | | (b) All other motor vehicles shall
exhibit at least 2 |
| 24 | | lighted head lamps, with at least one on each side
of the front |
| 25 | | of the vehicle, which satisfy United States Department of
|
|

| 1 | | Transportation requirements, showing white lights, including |
| 2 | | that emitted
by high intensity discharge (HID) lamps, or lights |
| 3 | | of a yellow or amber tint,
during the period from sunset to |
| 4 | | sunrise, at times when rain, snow, fog, or
other atmospheric |
| 5 | | conditions require the use of windshield wipers, and at
any |
| 6 | | other times when, due to insufficient light or unfavorable |
| 7 | | atmospheric
conditions, persons and vehicles on the highway are |
| 8 | | not clearly discernible at
a distance of 1000 feet. Parking |
| 9 | | lamps may be used in addition to but not in
lieu of such head |
| 10 | | lamps. Every motor vehicle, trailer, or semi-trailer shall
also |
| 11 | | exhibit at least 2 lighted lamps, commonly known as tail lamps, |
| 12 | | which
shall be mounted on the left rear and right rear of the |
| 13 | | vehicle so as to throw
a red light visible for at least 500 |
| 14 | | feet in the reverse direction, except that
a truck tractor or |
| 15 | | road tractor manufactured before January 1, 1968 and all
|
| 16 | | motorcycles need be equipped with only one such tail lamp.
|
| 17 | | (c) Either a tail lamp or a separate lamp shall be so |
| 18 | | constructed
and placed as to illuminate with a white light a |
| 19 | | rear registration plate
when required and render it clearly |
| 20 | | legible from a distance of 50 feet
to the rear. Any tail lamp |
| 21 | | or tail lamps, together with any separate
lamp or lamps for |
| 22 | | illuminating a rear registration plate, shall be so
wired as to |
| 23 | | be lighted whenever the head lamps or auxiliary driving lamps
|
| 24 | | are lighted.
|
| 25 | | (d) A person shall install only head lamps that satisfy |
| 26 | | United States
Department of Transportation regulations and |
