AMENDMENT TO SENATE BILL 225

2    AMENDMENT NO. ______. Amend Senate Bill 225 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Public Community College Act is amended by
5changing Section 3-8 as follows:
 
6    (110 ILCS 805/3-8)  (from Ch. 122, par. 103-8)
7    Sec. 3-8. In this Section, "reasonable emergency" means any
8imminent need to maintain the operations or facilities of the
9community college district and that such need is due to
10circumstances beyond the control of the board.
11    Following each election and canvass, the new board shall
12hold its organizational meeting on or before the 28th day after
13the election. If the election is the initial election ordered
14by the regional superintendent, the organizational meeting
15shall be convened by the regional superintendent, who shall
16preside over the meeting until the election for chairman, vice

1chairman and secretary of board is completed. At all other
2organizational meetings, the chairman of the board, or, in his
3or her absence, the president of the community college or
4acting chief executive officer of the college shall convene the
5new board, and conduct the election for chairman, vice chairman
6and secretary. The board shall then proceed with its
7organization under the newly elected board officers, and shall
8fix a time and place for its regular meetings. It shall then
9enter upon the discharge of its duties. Public notice of the
10schedule of regular meetings for the next calendar year, as set
11at the organizational meeting, must be given at the beginning
12of that calendar year. The terms of board office shall be 2
13years, except that the board by resolution may establish a
14policy for the terms of office to be one year, and provide for
15the election of officers for the remaining one year period.
16Terms of members are subject to Section 2A-54 of the Election
17Code.
18    Beginning 60 days prior to the Tuesday following the first
19Monday of April in odd-numbered years until the first
20organizational meeting of the new board, no addendum to modify
21and amend an employee agreement between a community college
22district and another party may be agreed to or executed, nor
23may an employment contract be made and entered into between the
24board of an established community college district and another
25party. If the current board must take such action at any time
26during the 60 days prior to the Tuesday following the first

1Monday of April in odd-numbered years until the first
2organizational meeting of the new board due to a reasonable
3emergency, then that action must be terminated within 30 days
4after the first organizational meeting, unless the new board,
5by resolution, reaffirms the agreed-upon addendum or new
6employment contract.
7    Special meetings of the board may be called by the chairman
8or by any 3 members of the board by giving notice thereof in
9writing stating the time, place and purpose of the meeting.
10Such notice may be served by mail 48 hours before the meeting
11or by personal service 24 hours before the meeting.
12    At each regular and special meeting which is open to the
13public, members of the public and employees of the community
14college district shall be afforded time, subject to reasonable
15constraints, to comment to or ask questions of the board.
