AMENDMENT TO SENATE BILL 586

2    AMENDMENT NO. ______. Amend Senate Bill 586 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Lottery Law is amended by changing
5Section 21.5 as follows:
 
6    (20 ILCS 1605/21.5)
7    Sec. 21.5. Carolyn Adams Ticket For The Cure.
8    (a) The Department shall offer a special instant
9scratch-off game with the title of "Carolyn Adams Ticket For
10The Cure". The game shall commence on January 1, 2006 or as
11soon thereafter, in the discretion of the Director, as is
12reasonably practical, and shall be discontinued on December 31,
132026 2016. The operation of the game shall be governed by this
14Act and any rules adopted by the Department. The Department
15must consult with the Carolyn Adams Ticket For The Cure Board,
16which is established under Section 2310-347 of the Department

1of Public Health Powers and Duties Law of the Civil
2Administrative Code of Illinois, regarding the design and
3promotion of the game. If any provision of this Section is
4inconsistent with any other provision of this Act, then this
5Section governs.
6    (b) The Carolyn Adams Ticket For The Cure Grant Fund is
7created as a special fund in the State treasury. The net
8revenue from the Carolyn Adams Ticket For The Cure special
9instant scratch-off game shall be deposited into the Fund for
10appropriation by the General Assembly solely to the Department
11of Public Health for the purpose of making grants to public or
12private entities in Illinois for the purpose of funding breast
13cancer research, and supportive services for breast cancer
14survivors and those impacted by breast cancer and breast cancer
15education. In awarding grants, the Department of Public Health
16shall consider criteria that includes, but is not limited to,
17projects and initiatives that address disparities in incidence
18and mortality rates of breast cancer, based on data from the
19Illinois Cancer Registry, and populations facing barriers to
20care. The Department of Public Health shall, before grants are
21awarded, provide copies of all grant applications to the
22Carolyn Adams Ticket For The Cure Board, receive and review the
23Board's recommendations and comments, and consult with the
24Board regarding the grants. For purposes of this Section, the
25term "research" includes, without limitation, expenditures to
26develop and advance the understanding, techniques, and

1modalities effective in the detection, prevention, screening,
2and treatment of breast cancer and may include clinical trials.
3The grant funds may not be used for institutional,
4organizational, or community-based overhead costs, indirect
5costs, or levies.
6    Moneys received for the purposes of this Section,
7including, without limitation, net revenue from the special
8instant scratch-off game and gifts, grants, and awards from any
9public or private entity, must be deposited into the Fund. Any
10interest earned on moneys in the Fund must be deposited into
11the Fund.
12    For purposes of this subsection, "net revenue" means the
13total amount for which tickets have been sold less the sum of
14the amount paid out in prizes and the actual administrative
15expenses of the Department solely related to the Ticket For The
16Cure game.
17    (c) During the time that tickets are sold for the Carolyn
18Adams Ticket For The Cure game, the Department shall not
19unreasonably diminish the efforts devoted to marketing any
20other instant scratch-off lottery game.
21    (d) The Department may adopt any rules necessary to
22implement and administer the provisions of this Section.

1Duties Law of the Civil Administrative Code of Illinois is
2amended by changing Section 2310-347 as follows:
 
3    (20 ILCS 2310/2310-347)
4    Sec. 2310-347. The Carolyn Adams Ticket For The Cure Board.
5    (a) The Carolyn Adams Ticket For The Cure Board is created
6as an advisory board within the Department. Until 30 days after
7the effective date of this amendatory Act of the 97th General
8Assembly, the Board may consist of 10 members as follows: 2
9members appointed by the President of the Senate; 2 members
10appointed by the Minority Leader of the Senate; 2 members
11appointed by the Speaker of the House of Representatives; 2
12members appointed by the Minority Leader of the House of
13Representatives; and 2 members appointed by the Governor with
14the advice and consent of the Senate, one of whom shall be
15designated as chair of the Board at the time of appointment.
16    (a-5) Notwithstanding any provision of this Article to the
17contrary, the term of office of each current Board member ends
1830 days after the effective date of this amendatory Act of the
1997th General Assembly or when his or her successor is appointed
20and qualified, whichever occurs sooner. No later than 30 days
21after the effective date of this amendatory Act of the 97th
22General Assembly, the Board shall consist of 10 newly appointed
23members. Four of the Board members shall be members of the
24General Assembly and appointed as follows: one member appointed
25by the President of the Senate; one member appointed by the

1Minority Leader of the Senate; one member appointed by the
2Speaker of the House of Representatives; and one member
3appointed by the Minority Leader of the House of
4Representatives.
5    Six of the Board members shall be appointed by the Director
6of the Department of Public Health, who shall designate one of
7these appointed members as chair of the Board at the time of
8his or her appointment. These 6 members appointed by the
9Director shall reflect the population with regard to ethnic,
10racial, and geographical composition and shall include the
11following individuals: one breast cancer survivor; one
12physician specializing in breast cancer or related medical
13issues; one breast cancer researcher; one representative from a
14breast cancer organization; one individual who operates a
15patient navigation program at a major hospital or health
16system; and one breast cancer professional that may include,
17but not be limited to, a genetics counselor, a social worker, a
18detain, an occupational therapist, or a nurse.
19    A Board member whose term has expired may continue to serve
20until a successor is appointed. A Board member who is not a
21member of the General Assembly may serve 2 consecutive 3-year
22terms and shall not be reappointed for 3 years after the
23completion of those consecutive terms.
24    (b) Board members shall serve without compensation but may
25be reimbursed for their reasonable travel expenses incurred in
26performing their duties from funds available for that purpose.

1The Department shall provide staff and administrative support
2services to the Board.
3    (c) The Board may advise:
4        (i) the Department of Revenue in designing and
5    promoting the Carolyn Adams Ticket For The Cure special
6    instant scratch-off lottery game;
7        (ii) the Department in reviewing grant applications;
8    and
9        (iii) the Director on the final award of grants from
10    amounts appropriated from the Carolyn Adams Ticket For The
11    Cure Grant Fund, to public or private entities in Illinois
12    that reflect the population with regard to ethnic, racial,
13    and geographical composition for the purpose of funding
14    breast cancer research and supportive services for breast
15    cancer survivors and those impacted by breast cancer and
16    breast cancer education. In awarding grants, the
17    Department shall consider criteria that includes, but is
18    not limited to, projects and initiatives that address
19    disparities in incidence and mortality rates of breast
20    cancer, based on data from the Illinois Cancer Registry,
21    and populations facing barriers to care in accordance with
22    Section 21.5 of the Illinois Lottery Law.
23    (c-5) The Department shall submit a report to the Governor
24and the General Assembly by December 31 of each year. The
25report shall provide a summary of the Carolyn Adams Ticket for
26the Cure lottery ticket sales, grants awarded, and the

2    (d) The Board is discontinued on June 30, 2027 2017.
