| 2 | | AMENDMENT NO. ______. Amend Senate Bill 679 as follows:

| 3 | | on page 1, line 5, immediately after "40", by inserting "and by |
| 4 | | adding Sections 42 and 51"; and
|
| 5 | | on page 2, immediately below line 23, by inserting the |
| 6 | | following: |
| 7 | | ""Commercial building" has the meaning ascribed to that |
| 8 | | term in subsection (d) of Section 10.09-1 of the Capital |
| 9 | | Development Board Act."; and

| 10 | | on page 16, immediately below line 23, by inserting the |
| 11 | | following:
|

| 13 | | Sec. 42. Other State authorities. |
| 14 | | (a) Any department, agency, instrumentality, or unit of |
|

| 1 | | local government of the State administering a program that |
| 2 | | involves the removal or replacement of mercury containing |
| 3 | | thermostats as a result of any statutory requirement, shall |
| 4 | | inform contractors of their statutory obligations to deliver |
| 5 | | the mercury-containing thermostats to a collection site and the |
| 6 | | prohibition on the disposal of those thermostats in a |
| 7 | | solid-waste facility. |
| 8 | | (b) Any contractor, organization, or subcontractor of an |
| 9 | | organization who contracts with or receives funding or |
| 10 | | financing provided in whole or in part by or through any |
| 11 | | department, agency, instrumentality, or unit of local |
| 12 | | government of the State for the installation, service, or |
| 13 | | removal of heating, ventilation, or air-conditioning |
| 14 | | components resulting in the removal or handling of |
| 15 | | out-of-service mercury thermostats shall ensure the |
| 16 | | collection, transportation, and proper management of |
| 17 | | out-of-service mercury thermostats in accordance with the |
| 18 | | provisions this Act.

| 20 | | Sec. 51. Removal of mercury thermostats from commercial |
| 21 | | buildings prior to demolition. Beginning January 1, 2016, no |
| 22 | | person shall demolish a commercial building unless (i) all |
| 23 | | mercury thermostats have been removed from the building and |
| 24 | | (ii) the person who removed the thermostats from the building |
| 25 | | has arranged for them to be delivered to a collection site |
