1 | | AN ACT concerning safety.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:

4 | | Section 5. The Fire Hydrant Act is amended by adding |
5 | | Section 2 as follows: |
6 | | (425 ILCS 20/2 new) |
7 | | Sec. 2. Recovery of costs; fire hydrant. |
8 | | (a) As used in this Section, "fire hydrant" means a water |
9 | | hydrant connected to a water supply system installed for the |
10 | | express purpose of providing water for fire suppression and |
11 | | that a fire department can connect to and from which it can |
12 | | pump or draw water. "Fire hydrant" does not include flush |
13 | | hydrants. |
14 | | (b) Whoever fails to comply with any of the provisions of |
15 | | this Act within 30 days after written notice of noncompliance |
16 | | or violation should reasonably have been received from a fire |
17 | | protection district, township fire department, or municipality |
18 | | in whose jurisdiction a fire hydrant is located, shall be |
19 | | responsible for all reasonable costs that the fire protection |
20 | | district, township fire department, or municipality incurs to |
21 | | correct the noncompliance, including attorney's fees and legal |
22 | | expenses incurred by the fire protection district, township |
23 | | fire department, or municipality in recovering the costs from |
