| 2 | | Be it enacted by the People of the State of Illinois,

| 3 | | represented in the General Assembly:

| 4 | | Section 5. The Public Utilities Act is amended by adding |
| 5 | | Section 9-211.5 as follows:
|

| 7 | | Sec. 9-211.5. Recovery of water and wastewater service |
| 8 | | revenue requirements. A public utility that provides both water |
| 9 | | and wastewater service may request in a general rate proceeding |
| 10 | | that the Commission allocate a portion of the public utility's |
| 11 | | water service revenue requirement for recovery through |
| 12 | | wastewater base rates or allocate a portion of the public |
| 13 | | utility's wastewater revenue requirement for recovery through |
| 14 | | water base rates, and, if requested, the Commission may approve |
| 15 | | the allocation if it can be shown to be in the public interest.
