| 3 | | everything after the enacting clause with the following:

| 4 | | "Section 5. The Property Tax Code is amended by changing |
| 5 | | Section 3-70 as follows: |
| 6 | | (35 ILCS 200/3-70) |
| 7 | | Sec. 3-70. Cessation of Township Assessor. |
| 8 | | (a) If the office of Township Assessor in a coterminous |
| 9 | | township ceases as provided in Article 27 of the Township Code, |
| 10 | | then the coterminous municipality shall assume the duties of |
| 11 | | the Township Assessor under this Code.

| 12 | | (b) If the office of Township Assessor ceases as provided |
| 13 | | in Article 28 of the Township Code, then the Supervisor of |
| 14 | | Assessments or County Assessor, as applicable, shall assume the |
| 15 | | duties of the Township Assessor under this Code. |

| 1 | | Section 10. The Township Code is amended by adding Article |
| 2 | | 28 as follows: |

| 4 | | ARTICLE 28. DISCONTINUANCE OF THE OFFICE OF TOWNSHIP ASSESSOR |

| 6 | | Sec. 28-5. Referendum to discontinue all offices of |
| 7 | | township assessor in a county. |
| 8 | | (a) The office of township assessor may be discontinued by |
| 9 | | referendum in all townships lying wholly within a county's |
| 10 | | borders upon (i) adoption of a resolution by the county board |
| 11 | | for the voters to approve by referendum the discontinuance of |
| 12 | | all township assessors, or (ii) filing of a petition, subject |
| 13 | | to the petition requirements of Section 28-3 of the Election |
| 14 | | Code, with the county board to approve by referendum the |
| 15 | | discontinuance of all township assessors signed by at least 10% |
| 16 | | of the registered voters of the county. |
| 17 | | (b) Upon adoption of the resolution or filing of the |
| 18 | | petition under subsection (a), the county board shall certify |
| 19 | | the question to the appropriate election officials and file |
| 20 | | with the county clerk. The resolution or petition shall be |
| 21 | | filed with the county clerk not less than 79 days prior to the |
| 22 | | general election in which the referendum will appear. |

| 2 | | Sec. 28-10. Referendum; approval. If a petition for a |
| 3 | | referendum is filed with the county clerk that meets the |
| 4 | | requirements of Section 27-5 of this Article, a referendum, |
| 5 | | subject to the requirements of 16-7 of the Election Code, shall |
| 6 | | be placed on the ballot at the next general election in |
| 7 | | substantially the following form: |
| 8 | | Shall the office of township assessor be abolished in |
| 9 | | all townships in … County and the duties of each township |
| 10 | | assessor be transferred to the county assessor or county |
| 11 | | supervisor of assessments. |
| 12 | | The votes shall be recorded as "Yes" or "No." The referendum is |
| 13 | | approved when a majority of the voters approve of the |
| 14 | | referendum. If approved, then the office of township assessor |
| 15 | | shall cease in each township in the county at the end of the |
| 16 | | current term of office of each township assessor. At the end of |
| 17 | | each township assessor's term (i) the county supervisor of |
| 18 | | assessments or county assessor, as applicable, shall assume the |
| 19 | | duties of the township assessor under the Property Tax Code, |
| 20 | | (ii) the county board members shall be the board of health for |
| 21 | | the public health district under the Public Health District |
| 22 | | Act, and (iii) the Office of the Township Collector shall also |
| 23 | | cease. |
| 24 | | Section 15. The Public Health District Act is amended by |
| 25 | | adding Section 27 as follows: |
