AMENDMENT TO SENATE BILL 1733 




2    AMENDMENT NO. ______. Amend Senate Bill 1733 by replacing 
3everything after the enacting clause with the following:

 
4    "Section 5. The Freedom of Information Act is amended  by 
5Section 3.7 as follows:
 
6    (5 ILCS 140/3.7 new)
7    Sec. 3.7. Personal identifying information.
8    (a) Notwithstanding any other provision of this Act, a 
9person who is incarcerated in any State, local, or federal 
10correctional facility for any offense under the laws of this 
11State may not request public documents containing personal 
12identifying information except as provided in this Section.
13    (b) A public record containing personal identifying 
14information which is requested by a person who is incarcerated 
15in any State, local, or federal correctional facility for any 
16offense under the laws of this State may be released only if

1the information is necessary to assist in the defense of the 
2requester. Upon motion by the requester, or his or her 
3representative, alleging  that the information is necessary to 
4assist in the requester's defense, the court shall make a 
5determination and issue a written order directing the public 
6body to either release the public record, in whole or in part, 
7or to withhold the public record from release to the 
8incarcerated person.".
