2 | Be it enacted by the People of the State of Illinois,

3 | represented in the General Assembly:
| ||||||||||||||||||||||||||||||||||||||
4 | Section 5. The Illinois Identification Card Act is amended | ||||||||||||||||||||||||||||||||||||||
5 | by changing Sections 2, 4, 7, 8, and 9 as follows:
| ||||||||||||||||||||||||||||||||||||||

7 | Sec. 2. Administration and powers and duties of the | ||||||||||||||||||||||||||||||||||||||
8 | Administrator. | ||||||||||||||||||||||||||||||||||||||
9 | (a) The Secretary of State is the Administrator of this | ||||||||||||||||||||||||||||||||||||||
10 | Act, and he is
charged with the duty of observing, | ||||||||||||||||||||||||||||||||||||||
11 | administering and enforcing the
provisions of this Act.
| ||||||||||||||||||||||||||||||||||||||
12 | (b) The Secretary is vested with the powers and duties for | ||||||||||||||||||||||||||||||||||||||
13 | the
proper administration of this Act as follows:
| ||||||||||||||||||||||||||||||||||||||
14 | 1. He shall organize the administration of this Act as | ||||||||||||||||||||||||||||||||||||||
15 | he may deem
necessary and appoint such subordinate | ||||||||||||||||||||||||||||||||||||||
16 | officers, clerks and other
employees as may be necessary.
| ||||||||||||||||||||||||||||||||||||||
17 | 2. From time to time, he may make, amend or rescind | ||||||||||||||||||||||||||||||||||||||
18 | rules and
regulations as may be in the public interest to | ||||||||||||||||||||||||||||||||||||||
19 | implement the Act.
| ||||||||||||||||||||||||||||||||||||||
20 | 3. He may prescribe or provide suitable forms as | ||||||||||||||||||||||||||||||||||||||
21 | necessary, including
such forms as are necessary to | ||||||||||||||||||||||||||||||||||||||
22 | establish that an applicant for an Illinois
Person with a | ||||||||||||||||||||||||||||||||||||||
23 | Disability Identification Card is a "disabled person" as |
| |||||||
| |||||||
1 | defined in
Section 4A of this Act, and establish that an | ||||||
2 | applicant for a State identification card is a "homeless | ||||||
3 | person" as defined in Section 1A of this Act.
| ||||||
4 | 4. He may prepare under the seal of the Secretary of | ||||||
5 | State certified
copies of any records utilized under this | ||||||
6 | Act and any such certified
copy shall be admissible in any | ||||||
7 | proceeding in any court in like manner
as the original | ||||||
8 | thereof.
| ||||||
9 | 5. Records compiled under this Act shall be maintained | ||||||
10 | for 6 years,
but the Secretary may destroy such records | ||||||
11 | with the prior approval of
the State Records Commission.
| ||||||
12 | 6. He shall examine and determine the genuineness, | ||||||
13 | regularity and
legality of every application filed with him | ||||||
14 | under this Act, and he may
in all cases investigate the | ||||||
15 | same, require additional information or
proof or | ||||||
16 | documentation from any applicant.
| ||||||
17 | 7. He shall require the payment of all fees prescribed | ||||||
18 | in this Act,
and all such fees received by him shall be | ||||||
19 | placed in the Road Fund of the
State treasury except as | ||||||
20 | otherwise provided in Section 12 of this Act. Whenever any | ||||||
21 | application to the Secretary for an identification card | ||||||
22 | under this Act is accompanied by any fee, as required by | ||||||
23 | law, and such application is refused or rejected prior to a | ||||||
24 | review of the applicant's eligibility for the | ||||||
25 | identification card, the fee shall be returned to the | ||||||
26 | applicant. If the application is denied after a review of |

| |||||||
1 | eligibility, which may include facial recognition | ||||||
2 | comparison and social security number verification, the | ||||||
3 | applicant shall not be entitled to a refund of any fees | ||||||
4 | paid.

7 | Sec. 4. Identification Card.
| ||||||
8 | (a) The Secretary of State shall issue a
standard Illinois | ||||||
9 | Identification Card to any natural person who is a resident
of | ||||||
10 | the State of Illinois who applies for such card, or renewal | ||||||
11 | thereof,
or who applies for a standard Illinois Identification | ||||||
12 | Card upon release as a
committed person on parole, mandatory | ||||||
13 | supervised release, aftercare release, final discharge, or
| ||||||
14 | pardon from the Department of Corrections or Department of | ||||||
15 | Juvenile Justice by submitting an identification card
issued by | ||||||
16 | the Department of Corrections or Department of Juvenile Justice | ||||||
17 | under Section 3-14-1 or Section 3-2.5-70 of the Unified
Code of | ||||||
18 | Corrections,
together with the prescribed fees. No | ||||||
19 | identification card shall be issued to any person who holds a | ||||||
20 | valid
foreign state
identification card, license, or permit | ||||||
21 | unless the person first surrenders to
the Secretary of
State | ||||||
22 | the valid foreign state identification card, license, or | ||||||
23 | permit. The card shall be prepared and
supplied by the | ||||||
24 | Secretary of State and shall include a photograph and signature | ||||||
25 | or mark of the
applicant. However, the Secretary of State may |
| |||||||
| |||||||
1 | provide by rule for the issuance of Illinois Identification | ||||||
2 | Cards without photographs if the applicant has a bona fide | ||||||
3 | religious objection to being photographed or to the display of | ||||||
4 | his or her photograph. The Illinois Identification Card may be | ||||||
5 | used for
identification purposes in any lawful situation only | ||||||
6 | by the person to
whom it was issued.
As used in this Act, | ||||||
7 | "photograph" means any color photograph or digitally
produced | ||||||
8 | and captured image of an applicant for an identification card. | ||||||
9 | As
used in this Act, "signature" means the name of a person as | ||||||
10 | written by that
person and captured in a manner acceptable to | ||||||
11 | the Secretary of State. | ||||||
12 | (a-5) If an applicant for an identification card has a | ||||||
13 | current driver's license or instruction permit issued by the | ||||||
14 | Secretary of State, the Secretary may require the applicant to | ||||||
15 | utilize the same residence address and name on the | ||||||
16 | identification card, driver's license, and instruction permit | ||||||
17 | records maintained by the Secretary. The Secretary may | ||||||
18 | promulgate rules to implement this provision.
| ||||||
19 | (a-10) If the applicant is a judicial officer as defined in | ||||||
20 | Section 1-10 of the Judicial Privacy Act or a peace officer, | ||||||
21 | the applicant may elect to have his or her office or work | ||||||
22 | address listed on the card instead of the applicant's residence | ||||||
23 | or mailing address. The Secretary may promulgate rules to | ||||||
24 | implement this provision. For the purposes of this subsection | ||||||
25 | (a-10), "peace officer" means any person who by virtue of his | ||||||
26 | or her office or public employment is vested by law with a duty |
| |||||||
| |||||||
1 | to maintain public order or to make arrests for a violation of | ||||||
2 | any penal statute of this State, whether that duty extends to | ||||||
3 | all violations or is limited to specific violations. | ||||||
4 | (a-15) The Secretary of State may provide for an expedited | ||||||
5 | process for the issuance of an Illinois Identification Card. | ||||||
6 | The Secretary shall charge an additional fee for the expedited | ||||||
7 | issuance of an Illinois Identification Card, to be set by rule, | ||||||
8 | not to exceed $75. All fees collected by the Secretary for | ||||||
9 | expedited Illinois Identification Card service shall be | ||||||
10 | deposited into the Secretary of State Special Services Fund. | ||||||
11 | The Secretary may adopt rules regarding the eligibility, | ||||||
12 | process, and fee for an expedited Illinois Identification Card. | ||||||
13 | If the Secretary of State determines that the volume of | ||||||
14 | expedited identification card requests received on a given day | ||||||
15 | exceeds the ability of the Secretary to process those requests | ||||||
16 | in an expedited manner, the Secretary may decline to provide | ||||||
17 | expedited services, and the additional fee for the expedited | ||||||
18 | service shall be refunded to the applicant. | ||||||
19 | (b) The Secretary of State shall issue a special Illinois
| ||||||
20 | Identification Card, which shall be known as an Illinois Person | ||||||
21 | with a Disability
Identification Card, to any natural person | ||||||
22 | who is a resident of the State
of Illinois, who is a person | ||||||
23 | with a disability as defined in Section 4A of this Act,
who | ||||||
24 | applies for such card, or renewal thereof. No Illinois Person | ||||||
25 | with a Disability Identification Card shall be issued to any | ||||||
26 | person who
holds a valid
foreign state identification card, |
| |||||||
| |||||||
1 | license, or permit unless the person first
surrenders to the
| ||||||
2 | Secretary of State the valid foreign state identification card, | ||||||
3 | license, or
permit. The Secretary of State
shall charge no fee | ||||||
4 | to issue such card. The card shall be prepared and
supplied by | ||||||
5 | the Secretary of State, and shall include a photograph and | ||||||
6 | signature or mark of the
applicant, a designation indicating | ||||||
7 | that the card is an Illinois
Person with a Disability | ||||||
8 | Identification Card, and shall include a comprehensible | ||||||
9 | designation
of the type and classification of the applicant's | ||||||
10 | disability as set out in
Section 4A of this Act. However, the | ||||||
11 | Secretary of State may provide by rule for the issuance of | ||||||
12 | Illinois Person with a Disability Identification Cards without | ||||||
13 | photographs if the applicant has a bona fide religious | ||||||
14 | objection to being photographed or to the display of his or her | ||||||
15 | photograph. If the applicant so requests, the card shall
| ||||||
16 | include a description of the applicant's disability and any | ||||||
17 | information
about the applicant's disability or medical | ||||||
18 | history which the Secretary
determines would be helpful to the | ||||||
19 | applicant in securing emergency medical
care. If a mark is used | ||||||
20 | in lieu of a signature, such mark
shall be affixed to the card | ||||||
21 | in the presence of two witnesses who attest to
the authenticity | ||||||
22 | of the mark. The Illinois
Person with a Disability | ||||||
23 | Identification Card may be used for identification purposes
in | ||||||
24 | any lawful situation by the person to whom it was issued.
| ||||||
25 | The Illinois Person with a Disability Identification Card | ||||||
26 | may be used as adequate
documentation of disability in lieu of |
| |||||||
| |||||||
1 | a physician's determination of
disability, a determination of | ||||||
2 | disability from a physician assistant who has
been delegated | ||||||
3 | the authority to make this determination by his or her
| ||||||
4 | supervising physician, a determination of disability from an | ||||||
5 | advanced practice
nurse who has a written collaborative | ||||||
6 | agreement with a collaborating physician
that
authorizes the | ||||||
7 | advanced practice nurse to make this determination, or any
| ||||||
8 | other documentation
of disability whenever
any
State law
| ||||||
9 | requires that a disabled person provide such documentation of | ||||||
10 | disability,
however an Illinois Person with a Disability | ||||||
11 | Identification Card shall not qualify
the cardholder to | ||||||
12 | participate in any program or to receive any benefit
which is | ||||||
13 | not available to all persons with like disabilities.
| ||||||
14 | Notwithstanding any other provisions of law, an Illinois Person | ||||||
15 | with a Disability
Identification Card, or evidence that the | ||||||
16 | Secretary of State has issued an
Illinois Person with a | ||||||
17 | Disability Identification Card, shall not be used by any
person | ||||||
18 | other than the person named on such card to prove that the | ||||||
19 | person
named on such card is a disabled person or for any other | ||||||
20 | purpose unless the
card is used for the benefit of the person | ||||||
21 | named on such card, and the
person named on such card consents | ||||||
22 | to such use at the time the card is so used.
| ||||||
23 | An optometrist's determination of a visual disability | ||||||
24 | under Section 4A of this Act is acceptable as documentation for | ||||||
25 | the purpose of issuing an Illinois Person with a Disability | ||||||
26 | Identification Card. |
| |||||||
| |||||||
1 | When medical information is contained on an Illinois Person | ||||||
2 | with a Disability
Identification Card, the Office of the | ||||||
3 | Secretary of State shall not be
liable for any actions taken | ||||||
4 | based upon that medical information.
| ||||||
5 | (c) The Secretary of State shall provide
that each original | ||||||
6 | or renewal Illinois Identification Card or Illinois
Person with | ||||||
7 | a Disability Identification Card issued to a person under the | ||||||
8 | age of 21
shall be of a distinct nature from those Illinois | ||||||
9 | Identification Cards or
Illinois Person with a Disability | ||||||
10 | Identification Cards issued to individuals 21
years of age or | ||||||
11 | older. The color designated for Illinois Identification
Cards | ||||||
12 | or Illinois Person with a Disability Identification Cards for | ||||||
13 | persons under
the age of 21 shall be at the discretion of the | ||||||
14 | Secretary of State.
| ||||||
15 | (c-1) Each original or renewal Illinois
Identification | ||||||
16 | Card or Illinois Person with a Disability Identification Card | ||||||
17 | issued to
a person under the age of 21 shall display the date | ||||||
18 | upon which the person
becomes 18 years of age and the date upon | ||||||
19 | which the person becomes 21 years of
age.
| ||||||
20 | (c-3) The General Assembly recognizes the need to identify | ||||||
21 | military veterans living in this State for the purpose of | ||||||
22 | ensuring that they receive all of the services and benefits to | ||||||
23 | which they are legally entitled, including healthcare, | ||||||
24 | education assistance, and job placement. To assist the State in | ||||||
25 | identifying these veterans and delivering these vital services | ||||||
26 | and benefits, the Secretary of State is authorized to issue |
| |||||||
| |||||||
1 | Illinois Identification Cards and Illinois Person with a | ||||||
2 | Disability Identification Cards with the word "veteran" | ||||||
3 | appearing on the face of the cards. This authorization is | ||||||
4 | predicated on the unique status of veterans. The Secretary may | ||||||
5 | not issue any other identification card which identifies an | ||||||
6 | occupation, status, affiliation, hobby, or other unique | ||||||
7 | characteristics of the identification card holder which is | ||||||
8 | unrelated to the purpose of the identification card.
| ||||||
9 | (c-5) Beginning on or before July 1, 2015, the Secretary of | ||||||
10 | State shall designate a space on each original or renewal | ||||||
11 | identification card where, at the request of the applicant, the | ||||||
12 | word "veteran" shall be placed. The veteran designation shall | ||||||
13 | be available to a person identified as a veteran under | ||||||
14 | subsection (b) of Section 5 of this Act who was discharged or | ||||||
15 | separated under honorable conditions. | ||||||
16 | (d) The Secretary of State may issue a Senior Citizen
| ||||||
17 | discount card, to any natural person who is a resident of the | ||||||
18 | State of
Illinois who is 60 years of age or older and who | ||||||
19 | applies for such a card or
renewal thereof. The Secretary of | ||||||
20 | State shall charge no fee to issue such
card. The card shall be | ||||||
21 | issued in every county and applications shall be
made available | ||||||
22 | at, but not limited to, nutrition sites, senior citizen
centers | ||||||
23 | and Area Agencies on Aging. The applicant, upon receipt of such
| ||||||
24 | card and prior to its use for any purpose, shall have affixed | ||||||
25 | thereon in
the space provided therefor his signature or mark.

26 | (e) The Secretary of State, in his or her discretion, may |
| |||||||
| |||||||
1 | designate on each Illinois
Identification Card or Illinois | ||||||
2 | Person with a Disability Identification Card a space where the | ||||||
3 | card holder may place a sticker or decal, issued by the | ||||||
4 | Secretary of State, of uniform size as the Secretary may | ||||||
5 | specify, that shall indicate in appropriate language that the | ||||||
6 | card holder has renewed his or her Illinois
Identification Card | ||||||
7 | or Illinois Person with a Disability Identification Card. | ||||||

12 | Sec. 7. Duplicate and corrected cards.
| ||||||
13 | (a) In the event an identification
card is lost or | ||||||
14 | destroyed, or if there is a correction of
legal name or
| ||||||
15 | residence address, or
a change in the type or class of | ||||||
16 | disability of a holder of an Illinois Person with a Disability | ||||||
17 | Identification Card, the
person named on the card may apply for | ||||||
18 | a duplicate or substitute card, or for a
corrected card. Any | ||||||
19 | application for a corrected card shall be accompanied by
the | ||||||
20 | original card being corrected.
| ||||||
21 | (b) The Secretary of State, having issued an identification | ||||||
22 | card in error,
may, upon
written notice of at least 5 days to | ||||||
23 | the person, require the person to appear
at a Driver
Services | ||||||
24 | facility to have the identification card error corrected and a | ||||||
25 | new
identification
card issued. The failure of the person to |
| |||||||
| |||||||
1 | appear is grounds for
cancellation of the
person's | ||||||
2 | identification card under Section 13 of this Act.
| ||||||
3 | (c) Notwithstanding any other provisions of this Act, the | ||||||
4 | Secretary of State shall restrict the issuance of multiple | ||||||
5 | duplicate identification cards and Illinois Person with a | ||||||
6 | Disability Identification Cards to any individual to 3 per year | ||||||
7 | and 10 for the life of individual. The Secretary may, in his or | ||||||
8 | her discretion, grant exceptions to these limits if the | ||||||
9 | applicant for a duplicate card can provide sufficient evidence | ||||||
10 | from an official source to establish that a duplicate | ||||||
11 | identification card is required. The Secretary may promulgate | ||||||
12 | rules to implement the requirements of this subsection. For | ||||||
13 | purposes of this Section, "official source" means any document | ||||||
14 | or report created by law enforcement, State or federal | ||||||
15 | government, the judiciary, and any other entity that the | ||||||
16 | Secretary may identify by rule. | ||||||

19 | Sec. 8. Expiration.
| ||||||
20 | (a) Except as otherwise provided in this Section: | ||||||
21 | (1) Every identification card issued hereunder,
except | ||||||
22 | to persons who have reached their 15th birthday, but are | ||||||
23 | not yet 21
years of age, persons who are 65 years of age or | ||||||
24 | older, and persons who are
issued an Illinois Person with a | ||||||
25 | Disability Identification Card, shall
expire 5 years from |

| |||||||
1 | the ensuing birthday of the
applicant and a renewal
shall | ||||||
2 | expire 5 years thereafter. | ||||||
3 | (2) Every original or renewal identification
card | ||||||
4 | issued to a person who has reached his or her 15th | ||||||
5 | birthday, but is
not yet
21 years of age shall expire 3 | ||||||
6 | months after the person's 21st birthday.
| ||||||
7 | (b) Except as otherwise provided in this Section, every | ||||||
8 | Every original, renewal, or duplicate (i) identification card | ||||||
9 | issued by July 1, 2016
to a
person who has reached his or her | ||||||
10 | 65th birthday shall expire 15 years thereafter be permanent and | ||||||
11 | need
not be renewed and (ii) Illinois Person with a Disability | ||||||
12 | Identification Card issued to a qualifying person shall expire | ||||||
13 | 10 years
thereafter. The Secretary of State shall adopt | ||||||
14 | promulgate rules setting forth the
conditions and criteria for | ||||||
15 | the renewal of all Illinois Person with a Disability | ||||||
16 | Identification Cards.
| ||||||
17 | (c) By July 1, 2016, every identification card or Illinois | ||||||
18 | Person with a Disability Identification Card issued under this | ||||||
19 | Act to an applicant who is not a United States citizen shall | ||||||
20 | expire on whichever is the earlier date of the following: | ||||||
21 | (1) as provided under subsection (a) or (b) of this | ||||||
22 | Section; | ||||||
23 | (2) on the date the applicant's authorized stay in the | ||||||
24 | United States terminates; or | ||||||
25 | (3) 12 months from the date of issuance, if the | ||||||
26 | applicant's authorized stay is indefinite. |

3 | Sec. 9. Renewal.
| ||||||
4 | (a) Any person having a valid identification card which | ||||||
5 | expires on
his or her 21st birthday, or which expires 3 months | ||||||
6 | after his
or her 21st birthday,
may not apply for renewal of | ||||||
7 | his or her existing identification card. A subsequent
| ||||||
8 | application filed by persons under this subsection, on or after | ||||||
9 | their 21st
birthday, shall be considered an application for a | ||||||
10 | new
card under Section 5
of this Act.
| ||||||
11 | (b) Any person having a valid identification card, except | ||||||
12 | those under
subsection (a), may apply for a one-time renewal, | ||||||
13 | in a manner prescribed by the
Secretary of State, within 30 | ||||||
14 | days after the expiration of the identification
card. A | ||||||
15 | subsequent application filed by that person shall be considered | ||||||
16 | an
application for a new card under Section 5 of this Act. | ||||||
17 | Except as otherwise provided in subsection (c) of Section 8 of | ||||||
18 | this Act, any Any identification
card
renewed under this | ||||||
19 | subsection shall be valid for 5 years after the expiration
date | ||||||
20 | of the identification card as originally issued under Section 5 | ||||||
21 | of this
Act. The Secretary of State, in his or her discretion, | ||||||
22 | may provide that applications for the one-time renewal under | ||||||
23 | this subsection (b) may be made by telephone, mail, or the | ||||||
24 | Internet, subject to any eligibility criteria and other | ||||||
25 | requirements that the Secretary of State deems appropriate.

1 | (c) Notwithstanding any other provision of this Act to the | ||||||
2 | contrary, a person convicted of a sex offense as defined in | ||||||
3 | Section 2 of the Sex Offender Registration Act may not renew | ||||||
4 | his or her Illinois Identification Card or Illinois Person with | ||||||
5 | a Disability Identification Card by telephone, mail, or the | ||||||
6 | Internet. | ||||||

9 | changing Sections 6-115 and 6-119 and by adding Section 6-122 | ||||||

16 | date, as the Secretary of State may by proper rule and | ||||||

that an applicant for renewal of a driver's license fails

the expiration date of the previous driver's | ||||||
20 | license, the renewal driver's

22 | such later date as the Secretary of State may

regulation designate, not to exceed 12 calendar months.

24 | The Secretary of State may, however, issue to a
person not |

1 | previously licensed as a driver in Illinois a driver's
license
| ||||||
2 | which will expire not less than 4 years nor more than 5
years | ||||||
3 | from date of
issuance, except as provided elsewhere in this | ||||||
4 | Section.
| ||||||
5 | The Secretary of State is authorized to issue driver's | ||||||
6 | licenses during
the years 1984 through 1987 which shall expire | ||||||
7 | not less than 3 years nor
more than 5 years from the date of | ||||||
8 | issuance, except as provided elsewhere
in this Section, for the | ||||||
9 | purpose of converting
all driver's licenses issued under this | ||||||
10 | Code to a 4 year expiration. Provided
that all original | ||||||
11 | driver's licenses, except as provided elsewhere in
this | ||||||
12 | Section, shall expire not less than 4 years nor more than
5 | ||||||
13 | years from the date of issuance.
| ||||||
14 | (a-5) By July 1, 2016, every driver's license issued under | ||||||
15 | this Code to an applicant who is not a United States citizen | ||||||
16 | shall expire on whichever is the earlier date of the following: | ||||||
17 | (1) as provided under subsection (a), (f), (g), or (i) | ||||||
18 | of this Section; | ||||||
19 | (2) on the date the applicant's authorized stay in the | ||||||
20 | United States terminates; or | ||||||
21 | (3) 12 months from the date of issuance, if the | ||||||
22 | applicant's authorized stay is indefinite. | ||||||
23 | (b) Before the expiration of a driver's license, except | ||||||
24 | those
licenses expiring on the individual's 21st birthday, or 3 | ||||||
25 | months after
the individual's 21st birthday, the holder thereof | ||||||
26 | may apply for a renewal
thereof, subject to all the provisions |

1 | of Section 6-103, and the Secretary
of State may require an | ||||||
2 | examination of the applicant. A licensee
whose driver's license | ||||||
3 | expires on his 21st birthday, or 3 months after
his 21st | ||||||
4 | birthday, may not apply for a renewal of his driving privileges
| ||||||
5 | until he reaches the age of 21.
| ||||||
6 | (c) The Secretary of State shall, 30 days prior to the | ||||||
7 | expiration of a
driver's license, forward to each person whose | ||||||
8 | license
is to expire a
notification of the expiration of said | ||||||
9 | license which may
be presented at the time of renewal of said | ||||||
10 | license.
| ||||||
11 | There may be included with such notification information | ||||||
12 | explaining
the anatomical gift and Emergency Medical | ||||||
13 | Information Card provisions of
Section 6-110. The format and | ||||||
14 | text of such information
shall be prescribed by the Secretary.
| ||||||
15 | There shall be included with such notification,
for a | ||||||
16 | period of 4 years beginning January 1, 2000 information | ||||||
17 | regarding the
Illinois Adoption Registry and Medical | ||||||
18 | Information Exchange established in
Section 18.1 of the | ||||||
19 | Adoption Act.
| ||||||
20 | (d) The Secretary may defer the expiration of the driver's | ||||||
21 | license
of a licensee, spouse, and dependent children who are | ||||||
22 | living with such licensee
while on active duty, serving in the | ||||||
23 | Armed Forces of the United
States outside of the State of | ||||||
24 | Illinois, and 120 days thereafter, upon such
terms and | ||||||
25 | conditions as the Secretary may prescribe.
| ||||||
26 | (e) The Secretary of State may decline to process a renewal |
| |||||||
| |||||||
1 | of a driver's
license
of any person who has not paid any fee or | ||||||
2 | tax due under this Code and is not
paid upon reasonable notice | ||||||
3 | and demand.
| ||||||
4 | (f) The Secretary shall provide that each original or | ||||||
5 | renewal driver's
license issued to a licensee under 21 years of | ||||||
6 | age shall expire 3 months
after the licensee's 21st birthday. | ||||||
7 | Persons whose current driver's licenses
expire on their 21st | ||||||
8 | birthday on or after January 1, 1986 shall not renew their
| ||||||
9 | driver's license before their 21st birthday, and their current | ||||||
10 | driver's
license will be extended for an additional term of 3 | ||||||
11 | months beyond their
21st birthday. Thereafter, the expiration | ||||||
12 | and term of the driver's license
shall be governed by | ||||||
13 | subsection (a) hereof.
| ||||||
14 | (g) The Secretary shall provide that each original or | ||||||
15 | renewal driver's
license issued to a licensee 81 years of age | ||||||
16 | through age 86 shall expire 2
years from the date of issuance, | ||||||
17 | or at such later date as the Secretary may
by rule and | ||||||
18 | regulation designate, not to exceed an additional 12 calendar
| ||||||
19 | months. The
Secretary shall also provide that each original or | ||||||
20 | renewal driver's license
issued to a licensee 87 years of age | ||||||
21 | or older shall expire 12 months from
the date of issuance, or | ||||||
22 | at such later date as the Secretary may by rule
and regulation | ||||||
23 | designate, not to exceed an additional 12 calendar months.
| ||||||
24 | (h) The Secretary of State shall provide that each special
| ||||||
25 | restricted driver's license issued under subsection (g) of | ||||||
26 | Section
6-113 of this Code shall expire 12 months from the date |

issuance. The Secretary shall adopt rules defining renewal
| ||||||
2 | requirements.
| ||||||
3 | (i) The Secretary of State shall provide that each driver's | ||||||
4 | license issued to a person convicted of a sex offense as | ||||||
5 | defined in Section 2 of the Sex Offender Registration Act shall | ||||||
6 | expire 12 months from the date of issuance or at such date as | ||||||
7 | the Secretary may by rule designate, not to exceed an | ||||||
8 | additional 12 calendar months. The Secretary may adopt rules | ||||||
9 | defining renewal requirements.

12 | Sec. 6-119. When fees returnable-drivers license.
| ||||||
13 | (a) Whenever any application to the Secretary of State for | ||||||
14 | a driver's license or permit under this Article is accompanied | ||||||
15 | by
any fee as required by law and such application is refused | ||||||
16 | or rejected prior to a review of the applicant's eligibility | ||||||
17 | for the driver's license or permit ,
the said fee shall be | ||||||
18 | returned to the said applicant. If the application is denied | ||||||
19 | after a review of eligibility, which may include facial | ||||||
20 | recognition comparison and social security number | ||||||
21 | verification, the applicant shall not be entitled to a refund | ||||||
22 | of any fees paid. | ||||||
23 | (a-5) If the Secretary of State determines that the volume | ||||||
24 | of expedited driver's license requests received on a given day | ||||||
25 | exceeds the ability of the Secretary to process those requests |

1 | in an expedited manner, the Secretary may decline to provide | ||||||
2 | expedited services, and the additional fee for the expedited | ||||||
3 | service shall be refunded to the applicant.
| ||||||
4 | (b) Whenever the Secretary of State through error collects | ||||||
5 | any fee not
required to be paid hereunder, the same shall be | ||||||
6 | refunded to the person
paying the same upon application | ||||||
7 | therefor made within 6 months after the
date of such payment.
| ||||||
8 | (c) Whenever a person dies after making application for a | ||||||
9 | drivers
license or permit under this Article, application for a | ||||||
10 | refund of the
drivers license or permit may be made if the | ||||||
11 | person dies prior to the
effective date for which application | ||||||
12 | has been made, and if the drivers
license or permit has never | ||||||
13 | been used. The Secretary of State shall refund
the drivers | ||||||
14 | license or permit fees upon receipt within 3 months after the
| ||||||
15 | application for a drivers license or permit of an application | ||||||
16 | for refund
accompanied with the drivers license or permit and | ||||||
17 | proof of death of the
applicant.

18 | (d) Any application for refund received after the times | ||||||
19 | specified in
this Section shall be denied and the applicant in | ||||||
20 | order to receive a refund
must apply to the Court of Claims.

23 | Sec. 6-122. Expedited driver's license. The Secretary of | ||||||

2 | issuance of an expedited driver's license, to be set by rule, | ||||||

5 | Secretary of State Special Services Fund. The Secretary may | ||||||
6 | adopt rules regarding the eligibility, process, and fee for an | ||||||
7 | expedited driver's license.

8 | Section 99. Effective date. This Act takes effect January | ||||||
9 | 1, 2016.
