| 1 | | AN ACT concerning criminal law.
|
| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Code of Criminal Procedure of 1963 is |
| 5 | | amended by changing Section 110-9 as follows:
|
| 6 | | (725 ILCS 5/110-9) (from Ch. 38, par. 110-9)
|
| 7 | | Sec. 110-9. Taking of bail by peace officer. When bail has |
| 8 | | been set by a judicial officer for a particular offense or
|
| 9 | | offender any sheriff or other peace officer may take bail in |
| 10 | | accordance
with the provisions of Section 110-7 or 110-8 of |
| 11 | | this Code and release
the offender to appear in accordance with |
| 12 | | the conditions of the bail bond,
the Notice to Appear or the |
| 13 | | Summons. The officer shall give a receipt to
the offender for |
| 14 | | the bail so taken and within a reasonable time deposit
such |
| 15 | | bail with the clerk of the court having jurisdiction of the |
| 16 | | offense. A sheriff or other peace officer taking bail in |
| 17 | | accordance with the provisions of Section 110-7 or 110-8 of |
| 18 | | this Code shall accept payments made in the form of currency, |
| 19 | | and may accept other forms of payment as the sheriff shall by |
| 20 | | rule authorize. For purposes of this Section, "currency" has |
| 21 | | the meaning provided in subsection (a) of Section 3 of the |
| 22 | | Currency Reporting Act.
