Amends the Public Utilities Act. Provides that public utilities shall file all utility extension advance deposit agreements with the Illinois Commerce Commission. Effective immediately.

| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:

| 4 | | Section 5. The Public Utilities Act is amended by adding |
| 5 | | Section 5-118 as follows:
|

| 7 | | Sec. 5-118. Utility extension advance deposit agreements. |
| 8 | | (a) As used in this Section, "utility extension advance |
| 9 | | deposit agreement" means an agreement between an applicant and |
| 10 | | an electric utility or gas utility to build or connect a new |
| 11 | | line extension from a development property to a utility. The |
| 12 | | agreement may include such items as engineering studies and |
| 13 | | plans, estimated construction costs, initial deposit amounts, |
| 14 | | refund of payment terms, property rights, timelines for work |
| 15 | | completed, and termination agreements. |
| 16 | | (b) Public utilities shall file all utility extension |
| 17 | | advance deposit agreements with the Commission.

| 18 | | Section 99. Effective date. This Act takes effect upon |
| 19 | | becoming law.
