AMENDMENT TO SENATE BILL 2323 




2    AMENDMENT NO. ______. Amend Senate Bill 2323, AS AMENDED, 
3with reference to page and line numbers of Senate Amendment No. 
42, on page 7, by replacing lines 3 through 15 with the 
5following:


 
6    "(55 ILCS 5/5-1005.1 new)
7    Sec. 5-1005.1. Mosquito abatement activities by DuPage 
8County.
9    (a) On the effective date of this amendatory Act of the 
1099th General Assembly, DuPage County shall discontinue all 
11mosquito abatement activities and all the rights, powers, 
12duties, assets, property, liabilities, obligations, and 
13responsibilities of DuPage County in relation to mosquito 
14abatement shall vest in and be assumed by the mosquito 
15abatement districts created in paragraph (4) of Section 11a of 
16the Mosquito Abatement District Act. Nothing in this Section 
17shall be construed to prevent DuPage County from leasing or

1selling mosquito abatement-related equipment or supplies to 
2one or more townships.
3    (b) Subsection (a) does not apply to the DuPage County 
4Health Department and any of its activities including, but not 
5limited to, mosquito surveillance, arbovirus testing, dead 
6bird reporting, human arboviral disease surveillance, public 
7education, and regulatory and emergency mosquito abatement 
8activities conducted by the DuPage County Health Department, or 
9its agents, as the Health Department determines to be necessary 
10and appropriate to protect public health and safety.".
