| 2 | | AMENDMENT NO. ______. Amend Senate Bill 2356, AS AMENDED, |
| 3 | | by replacing everything after the enacting clause with the |
| 4 | | following:
|
| 5 | | "Section 1. Short title. This Act may be cited as the |
| 6 | | Research Dogs and Cats Adoption Act.
|
| 7 | | Section 5. Definitions. In this Act: |
| 8 | | "Animal adoption organization" means any nonprofit |
| 9 | | organization incorporated for the purpose of adopting animals |
| 10 | | in need and finding permanent, adoptive homes for the animals. |
| 11 | | "Research facility" means an institution of higher |
| 12 | | education or corporation located in this State that receives |
| 13 | | public funds, federal or State, for scientific, educational, or |
| 14 | | research purposes or a facility that provides research in |
| 15 | | collaboration with an institution of higher education with the |
| 16 | | use of public funds and benefits from the result of that |

| 1 | | research. |
| 2 | | "Research facility adoption policy" means a prominently |
| 3 | | displayed adoption policy for dogs and cats that details the |
| 4 | | specific steps that staff, students, or the public can take to |
| 5 | | adopt a dog or cat that is no longer needed for research, |
| 6 | | testing, or education and, in the opinion of the institution's |
| 7 | | animal care committee and supervising veterinarian, would be a |
| 8 | | suitable dog or cat to be adopted.

| 9 | | Section 10. Research dogs and cats adoption requirement. |
| 10 | | (a) A research facility that owns and confines dogs or cats |
| 11 | | for scientific, educational, or research purposes and has |
| 12 | | completed all research requirements using the dog or cat shall |
| 13 | | then determine which animals are suitable for adoption under |
| 14 | | their research facility adoption policy and shall post a list |
| 15 | | of animals available under this policy. Any dogs or cats still |
| 16 | | available after employees, staff, and students have had an |
| 17 | | opportunity to adopt them shall be offered to a local animal |
| 18 | | adoption organization approved by the institution's animal |
| 19 | | care committee that has indicated to the facility that it would |
| 20 | | be willing to take the animals into its care. Dogs or cats |
| 21 | | belonging to private individuals that have been donated or |
| 22 | | loaned to the facility for medical trials or research and are |
| 23 | | to be returned to the owner are exempt from the requirements of |
| 24 | | this subsection (a). |
| 25 | | (b) A research facility that is required to offer dogs or |

| 1 | | cats to an animal adoption organization under this Section may |
| 2 | | enter into an agreement with the animal adoption organization |
| 3 | | to protect the research facility from liability. |
| 4 | | (c) A research facility that provides dogs or cats to an |
| 5 | | animal adoption organization under this Section is immune from |
| 6 | | any civil liability resulting from the research facility's |
| 7 | | actions as described under this Section, except for willful or |
| 8 | | wanton misconduct.

| 9 | | Section 99. Effective date. This Act takes effect upon |
| 10 | | becoming law.".
