AMENDMENT TO SENATE BILL 2527 




2    AMENDMENT NO. ______. Amend Senate Bill 2527 on page 2, 
3line 8, after "safety", by inserting ","; and
 


4on page 2, line 9, by replacing "(a)" with "(A)"; and


 
5on page 2, line 17, by replacing "(b)" with "(B)"; and
 


6on page 2, line 23, by replacing "(c)" with "(C)"; and


 
7on page 3, by replacing lines 4 through 22 with the following:


 
8    "The security portion of the system safety program, 
9including, without limitation, investigation reports, surveys, 
10schedules, lists, or data compiled, collected, or prepared by 
11or for the Department under this subsection, shall not be 
12subject to discovery or admitted into evidence in federal or 
13State court or considered for other purposes in any civil

1action for damages arising from any matter mentioned or 
2addressed in such reports, surveys, schedules, lists, data, or 
3information. 
4    Except for willful or wanton conduct, the Department and 
5its employees, and any local mass transit district, the 
6Regional Transportation Authority, St. Clair County Transit 
7District, or any Service Board subject to this Section, or 
8their respective directors, officers, or employees, shall not 
9be held liable in any civil action for any injury to or death 
10of any person or loss of or damage to property for any acts or 
11omissions or failures to act under this Section or pursuant to 
12the FAST Act as now or hereafter amended.".
