AMENDMENT TO SENATE BILL 2570




2    AMENDMENT NO. ______. Amend Senate Bill 2570, AS AMENDED, 
3by replacing everything after the enacting clause with the 
4following:

 
 
5    "Section 5. The Illinois Highway Code is amended  by adding 
6Section 4-106 as follows:
 
7    (605 ILCS 5/4-106 new)
8    Sec. 4-106. Misrepresentation.
9    (a) In relation to the submission of plans, maps, 
10specifications, costs of construction, bids, or contracts for 
11any Department project, it is unlawful for the Department, its 
12employees and its agents to knowingly falsify, distort, or 
13misrepresent any facts concerning, but not limited to, the 
14following:
15        (1) the character, quality, cost, or quantity of 
16    material already used or to be used;

1        (2) the quality or quantity of any work already 
2    performed or to be performed; and
3        (3) any other related costs.
4    (b) A violation of subsection (a) of this Section shall be 
5punishable by a fine of not more than $10,000 or by 
6imprisonment of not more than 5 years, or both. ".
