| 1 | | AN ACT concerning transportation.

| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Illinois Highway Code is amended by adding |
| 5 | | Section 9-132 as follows:
|
| 6 | | (605 ILCS 5/9-132 new) |
| 7 | | Sec. 9-132. Highway design. A unit of local government may |
| 8 | | consult a highway design publication outside the Department's |
| 9 | | Bureau of Local Roads and Streets Manual for the construction |
| 10 | | of any highway in ownership or control of the unit of local |
| 11 | | government, except for a highway that is part of the National |
| 12 | | System of Interstate and Defense Highways, if: |
| 13 | | (a) the unit of local government receives federal or State |
| 14 | | funds for the construction project; |
| 15 | | (b) the highway design publication is approved by the |
| 16 | | Federal Highway Administration; |
| 17 | | (c) the highway design publication is adopted by the unit |
| 18 | | of local government; and |
| 19 | | (d) the design complies with all other applicable federal |
| 20 | | laws.
