AMENDMENT TO SENATE BILL 2626

2    AMENDMENT NO. ______. Amend Senate Bill 2626 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Fire Protection District Act is amended by
5adding Section 15c as follows:
 
6    (70 ILCS 705/15c new)
7    Sec. 15c. Petition to cease operations and consolidate;
8referendum.
9    (a) Any municipality operating a fire department organized
10under the provisions of the Municipal Code may cease the
11operation and maintenance of its fire department and
12consolidate its fire protection services with an adjacent fire
13protection district by submitting a referendum to the voters
14residing in the municipality and the voters served by the fire
15protection district. The referendum proposing the dissolution
16and consolidation of the fire department shall be conducted in

1a manner that is consistent with the requirements provided by
2subsection (a) of this Section, except that the ballot for such
3election shall be in substantially the following form:
4- 
5    Shall the (name of fire 
6department) be dissolved and         YES 
7consolidated with the (name    ------------------------------------------------------------- 
8of fire protection district)?        NO 
9------------------------------------------------------------- 
10    If a majority of the votes cast on the question are in
11favor of such dissolution and consolidation, the court shall
12enter an order discontinuing the fire department and
13consolidating it with the fire protection district.
14    Thereafter, the fire protection district shall provide
15fire protection services within the municipality, shall
16receive the assets of the former fire department, shall receive
17funding from the municipality, and shall act as the fire
18department for the municipality.
19    The rights of the employees of the dissolved fire
20department provided by the Personnel Code, any applicable
21collective bargaining agreements, or under any pension,
22retirement, or annuity plan shall not be affected by this
23amendatory Act of the 99th General Assembly.
24    (b) A municipality that is a home rule or non-home rule
25unit may not dissolve a fire department and consolidate it with
26a fire protection district in a manner that is inconsistent

1with this Section. This Section is a limitation under
2subsection (i) of Section 6 of Article VII of the Illinois
3Constitution on the concurrent exercise by home rule units of
4the powers and functions exercised by the State.
 
5    Section 99. Effective date. This Act takes effect upon
6becoming law.".
