AMENDMENT TO SENATE BILL 2838 




2    AMENDMENT NO. ______. Amend Senate Bill 2838 by replacing 
3everything after the enacting clause with the following:

 
 
4    "Section 5. The Illinois Vehicle Code is amended by adding 
5Section 11-1413.5 as follows:
 
6    (625 ILCS 5/11-1413.5 new)
7    Sec. 11-1413.5. Ice and snow removal from vehicle.
8    (a)  A person operating  a vehicle of the second division 
9weighing more than 8,000 pounds upon a highway of this State 
10shall remove any ice and snow from the hood, roof, and sides of 
11the vehicle that poses a threat to the safety of other persons 
12or property on the highway during operation of the vehicle.
13    (b) This Section shall not apply to:
14        (1) a person operating a vehicle during a period of 
15    snow, sleet, or freezing rain if the period began and 
16    continued during the vehicle operation;

1        (2) a person operating a vehicle when the vehicle is 
2    parked; or
3        (3) a person operating an authorized emergency vehicle 
4    or a highway maintenance vehicle.
5    (c) A person who violates this Section shall be guilty of a 
6petty offense and shall be fined not more than $25 for a first 
7offense and not more than $50 for a second or subsequent 
8offense.".
