AMENDMENT TO SENATE BILL 2914

AMENDMENT NO. ______. Amend Senate Bill 2914 by replacing line 19 on page 5 through line 18 on page 6 with the following:

"(415 ILCS 5/22.59 new)

Sec. 22.59. Sanitary landfill operator certification.

(a) No person shall cause or allow the operation of a sanitary landfill that is required to be permitted under this Act unless the landfill has on its operational staff at least one individual who demonstrates a practical working knowledge of the design, operation, and maintenance of sanitary landfills.

(b) To demonstrate the practical working knowledge required under subsection (a) of this Section, an individual must pass, at least once every 3 years, a written exam that demonstrates competence in the following areas:

(1) unloading, spreading, and compacting of waste, litter collection, and vector abatement;

(2) traffic control of vehicles delivering waste;

(3) application, maintenance, and inspection of cover and cover requirements;

(4) fire control, on-site personnel safety requirements, and contingency plan implementation;

(5) leachate control operation, leachate management, and landfill gas management;

(6) identification of classes of waste;

(7) reporting and recordkeeping;

(8) financial assurance and groundwater monitoring requirements;

(9) development and implementation of contingency plans, closure plans, post-closure plans, and corrective action;

(10) acceptance and disposal of special wastes; and

(11) Board and Agency rules and permit requirements governing the operation of sanitary landfills.

(c) Written exams used to meet the requirements of this Section must be approved by the Agency. Written exams may be taken electronically.

(d) Notwithstanding any other provision of this Section, until July 1, 2019:

(1) an individual who is on the operational staff of a landfill that does not accept special waste may demonstrate the practical working knowledge required under subsection (a) of this Section by showing that he or she held on June 1, 2016 a valid Class "A" Solid Waste Site Operator Certificate issued by the Agency under the Solid Waste Site Operator Certification Law; and

(2) an individual who is on the operational staff of a landfill that does accept special waste may demonstrate the practical working knowledge required under subsection (a) of this Section by showing that he or she held on June 1, 2016 a valid Class "A" Solid Waste Site Operator Certificate issued by the Agency under the Solid Waste Site Operator Certification Law and a valid special waste certificate endorsement issued by the Agency under the Solid Waste Site Operator Certification Law.".
