1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Transportation Law of the
5Civil Administrative Code of Illinois is amended by changing
6Section 2705-575 as follows:
 
7    (20 ILCS 2705/2705-575)  (was 20 ILCS 2705/49.28)
8    Sec. 2705-575. Sale of used vehicles. Whenever the
9Department has deemed a vehicle has exhausted its useful life
10and shall be replaced, it shall notify the Division of Property
11Control of the Department of Central Management Services and
12the Division of Vehicles of the Department of Central
13Management Services for potential reallocation of the vehicle
14to another State agency through inter-agency transfer per
15standard fleet vehicle allocation procedures. If the vehicle is
16not re-allocated for use into the State fleet or agencies by
17the Division of Property Control or the Division of Vehicles of
18the Department of Central Management Services, the Department
19shall make the vehicle available for purchase by the public,
20including, but not limited to, to those units of local
21government that have previously requested the notification
22through an auction and provide them the opportunity to purchase
23the vehicle through a sealed bid sale. Any proceeds from the

1sale of a Department vehicle the vehicles to units of local
2government shall be deposited in the Road Fund, and used as
3provided in Section 8.3 of the State Finance Act. The term
4"vehicle" as used in this Section is defined to include
5passenger automobiles, light duty trucks, heavy duty trucks,
6and other self-propelled motorized equipment in excess of 25
7horsepower and attachments. The term "units of local
8government", as used in this Section, has the meaning ascribed
9to it in Section 1 of Article VII of the Illinois Constitution,
10and also includes entities named in Section 7b of the State
11Property Control Act.
