| 2 | | AMENDMENT NO. ______. Amend Senate Bill 3032 by replacing |
| 3 | | everything after the enacting clause with the following:

| 4 | | "Section 1. The Children and Family Services Act is amended |
| 5 | | by adding Section 39.4 as follows: |
| 6 | | (20 ILCS 505/39.4 new) |
| 7 | | Sec. 39.4. Child Death Investigation Task Force. The |
| 8 | | Department of Children and Family Services may, from funds |
| 9 | | appropriated by the Illinois General Assembly to the Department |
| 10 | | of Children and Family Services, or from funds that may |
| 11 | | otherwise be provided for this purpose from other public or |
| 12 | | private sources, establish in the Southern Region of the State, |
| 13 | | as designated by the Department of Children and Family |
| 14 | | Services, a special Child Death Investigation Task Force to |
| 15 | | develop and implement a plan for: (i) the investigation of |
| 16 | | sudden, unexpected, or unexplained deaths of children under 18 |

| 1 | | years of age occurring within that region and (ii) the |
| 2 | | investigation of missing and runaway children and children who |
| 3 | | are victims of sex trafficking within that region. The plan |
| 4 | | shall include a protocol to be followed. The plan must include |
| 5 | | provisions for local or State law enforcement agencies, |
| 6 | | hospitals, or coroners to promptly notify the Task Force of a |
| 7 | | death or serious life-threatening injury to a child, and for |
| 8 | | the Child Death Investigation Task Force to review the death |
| 9 | | and submit a report containing findings and recommendations to |
| 10 | | the Child Death Review Teams Executive Council, the Director of |
| 11 | | Public Health, the Director of Children and Family Services, |
| 12 | | the Department of Children and Family Services Inspector |
| 13 | | General, the appropriate State's Attorney, and the State |
| 14 | | Representative and State Senator in whose legislative |
| 15 | | districts the case arose. The plan may include coordination |
| 16 | | with any investigation conducted under the Children's Advocacy |
| 17 | | Center Act. On July 1 of each year, the Task Force shall submit |
| 18 | | a report to the Director of Children and Family Services, the |
| 19 | | General Assembly, and the Governor summarizing the results of |
| 20 | | the program together with any recommendations for statewide |
| 21 | | implementation of a protocol for the investigation of all |
| 22 | | sudden, unexpected, or unexplained child deaths and for the |
| 23 | | investigation of all cases involving missing and runaway |
| 24 | | children and children who are victims of sex trafficking. |
| 25 | | Section 5. The Child Death Review Team Act is amended by |

| 1 | | adding Section 50 as follows: |
| 2 | | (20 ILCS 515/50 new) |
| 3 | | Sec. 50. Child Death Review Team Transfer Task Force. |
| 4 | | (a) The Child Death Review Team Transfer Task Force is |
| 5 | | created within the Department of Children and Family Services |
| 6 | | to develop an implementation plan to effectuate the transfer of |
| 7 | | the administration of all child death review teams from the |
| 8 | | Department of Children and Family Services to the Department of |
| 9 | | Public Health. The implementation plan shall provide for the |
| 10 | | complete transfer of all child death review teams to the |
| 11 | | Department of Public Health by July 1, 2018. |
| 12 | | (b) The Task Force shall be co-chaired by the Director of |
| 13 | | Children and Family Services and the Director of Public Health |
| 14 | | and shall consist of the following members appointed as |
| 15 | | follows: |
| 16 | | (1) One project manager appointed by the Director of |
| 17 | | Children and Family Services. |
| 18 | | (2) One pediatrician knowledgeable
about child abuse |
| 19 | | and neglect appointed by the Director of Children and |
| 20 | | Family Services. |
| 21 | | (3) One forensic pathologist appointed by the Director |
| 22 | | of Public Health. |
| 23 | | The Director of Children and Family Services and the |
| 24 | | Director of Public Health may each appoint additional members |
| 25 | | as necessary to carry out the functions of the Task Force. |

| 1 | | (c) Members of the Task Force shall serve without |
| 2 | | compensation. Any vacancy occurring in the membership of the |
| 3 | | Task Force shall be filled in the same manner as the original |
| 4 | | appointment. |
| 5 | | (d) The Department of Children and Family Services shall |
| 6 | | provide administrative support to the Task Force. |
| 7 | | (e) The Task Force
is abolished and this Section is |
| 8 | | repealed on July 1, 2018. |

| 10 | | Section 15. The Child Death Review Team Act is amended by |
| 11 | | repealing Section 45.".
