SYNOPSIS AS INTRODUCED:
 
810 ILCS 5/2A-106  from Ch. 26, par. 2A-106

    Amends the Leases Article of the Uniform Commercial Code in relation to choice of judicial forum. Provides that if the forum chosen otherwise would not have jurisdiction over the lessee, the jurisdiction shall be that in which the lessee resides at the time the lease agreement becomes enforceable.

1    AN ACT concerning business.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Uniform Commercial Code is amended by
5changing Section 2A-106 as follows:
 
6    (810 ILCS 5/2A-106)  (from Ch. 26, par. 2A-106)
7    Sec. 2A-106. Limitation on power of parties to consumer
8lease to choose applicable law and judicial forum.
9    (1) If the law chosen by the parties to a consumer lease is
10that of a jurisdiction other than a jurisdiction in which the
11lessee resides at the time the lease agreement becomes
12enforceable or within 30 days thereafter or in which the goods
13are to be used, the choice is not enforceable.
14    (2) If the judicial forum chosen by the parties to a
15consumer lease is a forum that would not otherwise have
16jurisdiction over the lessee, the choice is not enforceable and
17the jurisdiction shall be that in which the lessee resides at
18the time the lease agreement becomes enforceable.
