SYNOPSIS AS INTRODUCED:
 
ILCON Art. IX, Sec. 9.5 new

    Proposes to amend the Revenue Article of the Illinois Constitution. Provides that revenue derived from taxes, fees, or bond proceeds relating to: registration, title, or operation of a vehicle; a public highway, road, street, or bridge; mass transit system, intercity passenger rail system, port, airport, or any other transportation infrastructure or operation; and fuel used for propelling vehicles, shall be expended only on the costs of administering laws, statutory refunds, and adjustments relating to vehicles and transportation, payment of highway obligations, matching federal aid highway funds, expense of grade separations at public highways and railroad crossings, and the costs of construction and maintenance of public highways, roads, streets, bridges, mass transit, intercity passenger rail, ports, airports, and other forms of transportation. Effective upon being declared adopted in accordance with Section 7 of the Illinois Constitutional Amendment Act.

3    RESOLVED, BY THE SENATE OF THE NINETY-NINTH GENERAL
4ASSEMBLY OF THE STATE OF ILLINOIS, THE HOUSE OF REPRESENTATIVES
5CONCURRING HEREIN, that there shall be submitted to the
6electors of the State for adoption or rejection at the general
7election next occurring at least 6 months after the adoption of
8this resolution a proposition to add Section 9.5 to Article IX
9of the Illinois Constitution as follows:

13SECTION 9.5. HIGHWAY REVENUE
14    (a) No revenue derived from the taxes, fees, or bond
15proceeds relating to: registration, title, operation of a
16vehicle; a public highway, road, street, or bridge; a mass
17transit system, intercity passenger rail system, port,
18airport, or any other transportation infrastructure or
19operation; and fuel used for propelling vehicles, shall be
20expended except for the costs of administering laws, statutory
21refunds, and adjustments related to vehicles and
22transportation, payment of highway obligations and other
23statutory highway purposes, matching federal aid highway

1funds, expense and protection of grade separations at public
2highways and railroad crossings, costs of construction,
3maintenance, repair, and betterment of public highways, roads,
4streets, bridges, mass transit, intercity passenger rail,
5ports, airports, and other forms of transportation, and any
6other transportation purpose as authorized by law. The costs of
7administering laws related to vehicles and transportation
8shall be limited to direct program expenses of the Secretary of
9State, the Department of State Police, and the Department of
10Transportation, or their successor agencies, relating to the
11enforcement of traffic laws or the safety of public highways,
12roads, streets, bridges, mass transit, intercity passenger
13rail, ports, or airports.
14    (b) The revenue described in subsection (a) of this Section
15shall not be diverted by transfer, offset, or otherwise, for
16any purpose other than those described in that subsection.
17    (c) Any mode of transportation not described in subsection
18(a) of this Section that is first proposed for State funding
19after this Section takes effect shall have a dedicated source
20of funding.
21    (d) Revenue derived from federal funds may be spent for any
22purpose authorized by federal law.

SCHEDULE
24    This Constitutional Amendment takes effect upon being
25declared adopted in accordance with Section 7 of the Illinois
